Description: The Trending Patent Issues Panel of the JPPCLE seminar presented three important cases with a special presentation from James Porter, the (Acting) Divisioinal Director – Policy, United Kingdom Intellectual Property Office who discussed the impact of Brexit on the various IP offices in the UK and Europe.  Mr. Porter covered the changes in the structure of the of the UK Intellectual Property Offices in the UK, and the policies that have been adopted to cover IP rights in the UK in both a forward and rearward view.  Eric Baron, a Partner at Cantor Colburn LLP, led a discussion on the trending issue of “Who is the Inventor when AI Conceives?”  The discussion touched on the growing number of patent applications based on Artificial Intelligence, as well as one case in particular where some believe that the inventor should be “DABUS”, an Artificial Intelligence system.   Also, John Moehringer, a Partner at Cadwalader Wickersham & Taft, led a talk on “IP considerations and strategies for Blockchain and NFTs.”  John discussed the various trends in the numbers of patent applications filed covering NFTs and Blockchain technology, as well as a summary of the parties seeking protection in these areas.  Finally, Keith McWha, a Partner at Lerner David, Littenberg Krumholz & Mentlik LLP, covered the topic of Compulsory Licensing & March-in Rights in Covid-19 Vaccine Production.  The discussion covered the history of Compulsory Licensing & March-In Rights, and how the WTO has considered such measures in wake of COVID-19 and the technology used in the vaccines.
