Description: IPR theft in international trade is on the rise, with adverse consequences for workers, importers, consumers, right holders, and states. Against this backdrop, CBP has, in collaboration with partner government agencies and industry, stepped up its efforts to improve compliance tools, provide protective solutions, and enhance enforcement capabilities. This posture is evident in CBP’s identification of IPR theft as a “Priority Trade Issue” at the same time, agencies in other countries are also paying increasing attention to IPR theft and its prevention.
 
This CLE program will enable participants to understand the IPR risks that can arise in the international trade environment and develop U.S- and/or foreign-focused strategies to protect their interests.

Presenter Bios 
 
Fred Rocafort leads Harris Sliwoski’s intellectual property practice and is the coordinator of the firm’s international team. He is dedicated to helping businesses from around the world and across industries protect their brands as they grow. Many of Fred’s clients operate in spaces that constitute new frontiers for IP law, such as cannabis, psychedelics, and Web3. Prior to joining Harris Sliwoski, Fred worked in China for more than a decade, in both government and private sector roles. He is a regular commentator on brand protection matters and serves as an expert witness on IP-related cases.
 
Fred began his career overseas as a U.S. consular officer in Guangzhou, where he advocated for fairer treatment of American companies and citizens in China and for stronger intellectual property rights enforcement. After entering the private sector, Fred worked at a Shanghai law firm as a foreign legal advisor and later joined one of the oldest American law firms in China, helping foreign companies navigate the Chinese legal environment. He also led the legal team at a Hong Kong-based brand protection consultancy, spending most of his time out in the field, protecting clients against counterfeiters and fraudsters, and helping secure their R&D and manufacturing facilities in Greater China, Southeast Asia, and Latin America.
 
In addition to his IP work, Fred advises clients doing business overseas on corporate matters, leveraging his proficiency in Spanish and Chinese.  On any given day, Fred will guide clients as they set up an S. de R.L. in Mexico, explore opportunities in Thailand’s budding cannabis market, vet potential business partners in Brazil, negotiate manufacturing agreements with suppliers in Colombia, and take down infringing listings from e-commerce sites in China.
 
Fred is an ardent supporter of FC Barcelona—and would be even in the absence of Catalan forebears who immigrated to Puerto Rico in the mid-1800s.
 
 
Robert Kossick is a Board-Certified International Attorney, Licensed Customs Broker, and Certified Export Specialist whose practice focuses on the planning, compliance, enforcement, and security dimensions of U.S. import and export transactions. With over twenty years of professional experience split between the United States and Latin America, Robert brings seasoned, specialized, and multicultural know-how and perspective to the analysis and resolution of customs and trade issues.
 
As a member of A.N. Deringersi’s international trade law group, Robert helps clients optimize duties, demonstrate reasonable care, comply with PGA requirements, obtain export licenses and permits, protect intellectual property rights, achieve supply chain security, navigate import entry/liquidation and export clearance/verification processes, challenge administrative determinations, respond to agency inquiries and communications, and disclose violations. On enforcement matters, Robert works zealously to blunt the impact of penalty, seizure/forfeiture (merchandise and currency), and liquidated damages claims.
 
Robert has, over the course of his legal career, practiced customs and trade law with a Fortune 50 corporation, worked as a foreign legal consultant in Mexico, served as a trade policy analyst under former U.S. Trade Representative William Brock, and provided trade consulting/advisory services for the World Bank, the U.S. Agency for International Development, and the Washington District Export Council (DEC). Prior to becoming a lawyer, Robert worked as a credit analyst with a large commercial bank, conducted independent archaeological fieldwork under the auspices of the Instituto Nacional de Antropología e Historia, and served as an infantryman in the United States Marine Corps.
 
Robert holds a Ph.D. in International Trade and an LL.M. in Inter-American Law, writes and speaks on international trade matters, and is proficient in Spanish. When not engaged with clients on customs and trade issues, Robert enjoys reading, writing, preserving historic properties, woodworking, gardening, skiing, trekking, and Airstreaming with his wife.
