Description:
Recent legislative developments may significantly impact the franchisor-franchisee relationship more than ever before.

Our program will review the new and anticipated laws and rules effect on franchising and provide guidance on whether and how franchise participants can minimize risk and avoid liability arising from the franchise relationship.

Marc Lieberstein is a partner at Kilpatrick Townsend, where he co-chairs the firm's Franchise Group and Retail & Consumer Goods industry team. His practice centers around intellectual property licensing and franchising in various industries, including retail/consumer goods and services, fashion/apparel and accessories, food and beverage, and commercial/industrial design.

Lieberstein's expertise involves drafting, negotiating, and enforcing license and franchise agreements, as well as implementing branding and commercialization strategies for clients through licensing and franchising. In conjunction with these services, he counsels clients on developing effective strategies for procuring, protecting, and enforcing their global intellectual property assets.

Lieberstein has leveraged alternative dispute resolution methods, such as arbitration and mediation, to enforce intellectual property rights and resolve contractual disputes related to licenses and franchises. He frequently lectures and writes on intellectual property and franchise topics for various organizations and publications, including the International Trademark Association (INTA), New York State Bar Association Intellectual Property Section, American Bar Association Forum on Franchising, The Franchise Lawyer, Franchise Law Journal, National Law Journal, IP Strategist, The New York Law Journal, Practical Law, and The Licensing Journal.

Chris Caiaccio is a partner at Kilpatrick Townsend, where he has practiced exclusively in the area of labor and employment law throughout his legal career.

Caiaccio has extensive experience working with employers to assist with various human resource issues, including employment discrimination, non-compete agreements, employment contracts, sexual harassment, wage and hour issues, and independent contractor misclassification. He regularly advises clients on labor relations matters, such as union avoidance, unfair labor practice charges, secondary boycotts, collective bargaining, strike contingency planning, grievance and arbitration, and other matters involving the National Labor Relations Board.

Caiaccio also counsels clients on labor law issues impacting employers in the construction industry, including double-breasting, project labor agreements, and Davis Bacon Act compliance. His practice involves providing guidance to employers on a wide range of labor and employment law matters to help them navigate complex regulatory environments and mitigate risks.
