Description: Our esteemed panel will discuss key issues in dispute resolution, with a focus on the importance of giving a voice to the parties involved in a matter. One of the key advantages of mediation is the ability to be heard by a neutral party who is genuinely interested in the facts and arguments giving rise to the dispute. The ability of the parties to tell their story to someone who is listening and empathetic to their problem is central to a successful mediation.
 
This program will address the benefits of mediation, the role of the mediator and other parties present at the mediation, the purpose of a mediation statement and other insights into the process, as well as best practices to keep the mediation focused to ensure a successful outcome.
 
Presenter Bios 
 
Larry Schiffer, Esq. is one of the foremost authorities on insurance/reinsurance matters he has a wealth of knowledge and experience spans both the property and casualty and the life and
health markets, and includes long-term care, captives, brokers and intermediaries, run off
entities and surplus and excess lines. He is well known throughout the insurance and legal
communities for litigating, arbitrating and mediating insurance and reinsurance matters and
complex commercial litigation disputes.
 
Mr. Schiffer is well-respected professionally and has provided counsel and advice on a wide
variety of insurance and reinsurance issues including coverage, insolvency, commutations
and recaptures, due diligence for corporate transactions and investments, reinsurance audits
and inspections, cyber insurance, claims analysis, contract wording, communications, policies and procedures between insurers and related issues.
Mr. Schiffer has worked on some of the largest insurance and reinsurance coverage disputes in the country including the World Trade Center Respiratory Coverage Litigation; the NFL Concussion Coverage Litigation, a significant Madoff bond dispute and the
Unicover debacle reinsurance arbitration. Additionally, he has litigated complex commercial disputes, employment, insurance regulatory and product liability matters.
 
As a mediator, Mr. Schiffer has been selected to mediate all types of commercial and civil disputes including employment and contract cases, pending in the State and Federal Courts.

Jim Borkowski, Esq. a trial attorney for over 33 years, Jim Borkowski is known as a personable straight shooter, with a high success rate resolving construction cases, premises liability cases, general liability, and automobile claims.

For the third year in a row, Jim was recognized by his peers as a Top Ten Neutral in New York
State in the 2022 New York Law Journal Best Of Survey. He earned an “AV Distinguished” rating
from Martindale-Hubbell, a distinction given only to those who possess the “highest level of
professional excellence in legal ability and legal ethics”.
 
As a practitioner, Jim represented insurance carriers, corporations, and individuals in personal
injury, construction, labor law, premises liability, property damage, and automobile claims. He
tried over 100 jury trials in the Metro New York area. Recognizing the risk mitigation and cost savings for clients, Jim spent many years of his career negotiating settlements through private mediation.
 
Prior to joining NAM, Jim served as a Town Justice in the Town of Southeast, one of the busiest Justice Courts in New York State.  In that role, for 11 years (1998 – 2009), he presided over jury and non-jury trials and facilitated the settlement of hundreds of civil
and commercial cases.
 
Jim began his career in 1987 as an Assistant District Attorney in the Nassau County District Attorney’s Office, where he litigated trials, pre-trial hearings, and presented cases before grand juries. Subsequently, in the early nineties, he was an associate for a prominent New York City law firm, where he was a member of a special litigation team investigating liability theories for the
Lockerbie Air Disaster (Flight 103). He also served as an attorney for the New York City Housing Authority (NYCHA) for personal injury actions, and litigated commercial, insurance, and foreclosure matters for the firm.
 
Jim is available to arbitrate and mediate cases throughout the New York Metro area.
