Description: Please join patent attorneys Tasha Gerasimow and Jeanna Wacker as they discuss the Safe Harbor Provision as it relates to patent infringement.

Tasha and Jeanna will provide answers to the who, what, when, where and why questions related to the defense, including who can raise it, what the protection does and does not cover, when and where it can be raised, and why it is important to think about the boundaries of this provision prior to litigation.

Presenter Bios

Tasha Francis Gerasimow, Ph.D. is a partner in the Chicago office of Kirkland & Ellis LLP, where she focuses her practice on intellectual property litigation with an emphasis on patent litigation. Her clients range from solo inventors and emerging companies in the biotechnology and biopharma industries to established international pharmaceutical and medical device companies. She has extensive experience in the areas of small molecule and biologic pharmaceuticals (including antibody technologies), drug formulation and drug delivery technologies, diagnostics, protein biochemistry, and chemicals.

Tasha has represented plaintiffs and defendants in cases involving medical devices, biotechnology, and pharmaceuticals in district court, the ITC and in post-grant proceedings. Tasha also works with a variety of pro bono clients on issues including patent applications, contract disputes, death penalty appeals, habeas petitions, and amicus briefing.

Tasha is passionate about the advancement of women in STEM and law. She regularly volunteers with local Girl Scouts troops, helping them learn about inventorship, entrepreneurship and the basic tenets of intellectual property law, specifically copyrights, trademarks and patents.

Jeanna Wacker, P.C. is a partner in the New York office of Kirkland & Ellis LLP. She is an experienced trial lawyer and concentrates her practice on patent litigation in the life sciences field. Jeanna has extensive experience representing clients in the pharmaceutical, biotechnology, chemical and medical device industries and has represented both plaintiffs and defendants at all stages of litigation, including trials (bench and jury) and appeal. Jeanna also has experience in inter partes reviews before the United States Patent and Trademark Office. Her clients have included some of the largest companies in the life sciences area such as, Bristol-Myers Squibb, Eagle Pharmaceuticals, Hoffman La-Roche, Boehringer Ingelheim, Teva Pharmaceuticals, Pfizer, E.I. du Pont de Nemours, and Novartis Pharmaceuticals. Jeanna has established a reputation as a leading litigator in the life sciences field and is regularly invited to speak on hot topics in this area.

Jeanna is also regularly called upon to advise pharmaceutical and biotech companies on intellectual property aspects of corporate merger agreements and product acquisitions.

Jeanna was recognized for Patent Litigation in The Legal 500 U. S. 2018 and was named a New York Super Lawyer in 2019 by Super Lawyers magazine.
