Description: This CLE will provide an overview of the slayer statutes in California, Florida, Texas, and Missouri.
 
The presentation will cover historical overview of the statute (including amendments and expansions), it’s application, burden of proof issues, penalties imposed on the slayer, and related attorneys fee issues.
 
 
Presenter Bios 
 
Giovanna (“Gia”) Abreu O’Connor is a Senior Attorney and leads the Miami office of RMO, which she helped launch. Gia’s practice focuses on representing beneficiaries and fiduciaries—e.g., administrators, executors, trustees, conservators, and guardians—in contested trust, estate, and guardianship litigation, as well as related estate and guardianship administration issues. Gia also has meaningful experience in handling commercial and business disputes, real estate transactions and disputes, and appeals. Gia works closely with clients, resolving cases with efficiency and innovation and obtaining advantageous outcomes. 
 
Gia grew up in Miramar, Puerto Rico and graduated from Florida International University with a B.A. in International Relations. She then attended Florida International University College of Law, where she served as a Dean’s Fellow to the Assistant Dean of Development, graduate assistant to Dr. Stanley Fish, and interned with the Probate Division of the 11th Judicial Circuit in Miami.
 
Tom Nanney is Of Counsel with RMO LLP and leads the firm’s Kansas City office.  In addition to his role with RMO, Tom serves as a Visiting Associate Professor at the University of Missouri – Kansas City School of Law.   Prior to his professorship, Tom was a litigator in private practice with a large, international law firm and an Assistant Attorney General with the Kansas Attorney General’s Office.  Tom’s practice with RMO focuses on counseling clients involved in disputed trust, estate and probate litigation as well as general business litigation. 
 
David Greco is a Partner with RMO LLP and Managing Attorney in the San Diego office, which he helped launch.  David also chairs the firm’s appellate practice. He represents beneficiaries, as well as professional and corporate fiduciaries – e.g. administrators, executors, trustees, conservators, and guardians – in contested trust, estate, and probate litigation matters, as well as related estate administration issues.
 
David previously worked for the California Court of Appeal, the California Attorney General’s Office, and the U.S. District Court for the Southern District of California. He graduated magna cum laude from the University of San Diego School of Law, where he was a member of the San Diego Law Review.
 
Andrea L. Uresti Barr launched and serves as Managing Attorney of RMO’s Houston office. A seasoned probate litigator, Andrea’s area of practice includes defending and prosecuting causes of action on behalf and against heirs, beneficiaries, fiduciaries, and creditors in probate, trust, guardianship, and power of attorney proceedings.  Andrea also handles contested estate, probate, and trust administrations.
 
In the context of probate litigation, Andrea has experience handling several commercial real estate transactions (including acreage), commercial and dram shop liability litigation, equitable and statutory bill of review proceedings, and appeals.
 
Andrea defends wrongfully accused fiduciaries but also prosecutes fiduciaries who have abused their position, including experience handling several commercial real estate transactions (including acreage), commercial and dram shop liability litigation, equitable and statutory bill of review proceedings, and appeals. Andrea also has extensive experience pursuing and defending will contests and trust contests, including claims for incapacity, undue influence, financial elder abuse, fraud and forgery.
 
Andrea is from College Station, Texas, and moved to Houston, Texas in 1999.  She graduated from University of Houston and University of Houston Law Center.  While pursuing her law degree, she participated as a student attorney in the transactional clinic at the University of Houston Law Center where she formed entities and drafted agreements related to entity formation, liability, and employment.  While serving as an intern appellate brief writer at the Harris County District Attorney’s Office, she filed five successful appellate briefs and created a new system with the Fourteenth and First Court of Appeals to retrieve records and evidence.  She also served as Chief Articles Editor for the Houston and Business Tax Law Journal in 2012 to 2013 and was elected Editor of the Year for 2012 to 2013.  She was a member of the University of Houston Law Center Moot Court Team as a brief writer. She received the Samson Memorial Animal Law Scholarship in 2012 to 2013.
