Description: This entertaining presentation helps lawyers draft better contracts by looking at numerous examples of “bad” drafting. Attendees will learn the two different meanings of “contract,” the types of ambiguity and importance of avoiding ambiguity, common drafting mistakes, how certain contract provisions (or the absence of them) may impact litigation, and real world benefits of reducing “Legalese” in contracts.

Mark Cohen passion is drafting clear legal documents and helping clients resolve disputes arising out of poorly drafted documents (or the lack of any documents at all). 
 
Mark’s practice includes five broad areas: (1) drafting and reviewing legal documents, (2) advising businesses and organizations, (3) business and real estate litigation, (4) speaking, teaching, and writing, and (5) serving as co-counsel or a mentor.
 
Mark Cohen's HOW TO DRAFT A BAD CONTRACT is “Simply brilliant.” - Steven Pinker, Professor of Psychology, Harvard University. The distinction between litigation and transactional work is often artificial.  Businesscontractintellectual property, employment, and real estate litigation are almost always the result of poor drafting, insufficient investigation, or an incomplete negotiation.  He prefers plain English over "Legalese."  Plain English lowers costs, improves productivity, increases credibility,  and reduces misunderstandings.
 
I am also a proven TRIAL LAWYER.  In 2012, I won a $4.2 million judgment (including punitive damages) for a client in a case involving breach of contract and interference with contract.  I have represented clients in more than 100 jury trials and litigated hundreds of civil cases.  My experience enables me to facilitate transactions today that are least likely to become lawsuits tomorrow.  Read more about my trial practice and philosophy.
 
He earned my B.A. in economics in 1980 at Whitman College, the alma mater of William O. Douglas.  He earned my law degree in 1983 at the University of Colorado School of Law in Boulder.  He earned a Masters in Law (LL.M.) in agricultural and food law at the University of Arkansas School of Law in 2014.  He also studied philosophy and logic in graduate school and he is a member of the Institute of General Semantics.  He is an AV-rated attorney and was selected as a Super Lawyer in Business Litigation for 2021.  His AVVO rating is presently a perfect 10 out of 10.  He was selected by Expertise.com as one of the best real estate lawyers in Denver.
