Description:
This program will discuss what trustees, fiduciaries, and financial institutions can and cannot do with trust funds. We will cover the use of trust funds to pay attorneys’ fees—both for litigation and administration—as well as what types of expenses and trustees’ fees courts across the country have approved or disapproved. The program will review recent cases from several jurisdictions, including California, Florida, and Missouri.
 
David Greco is an attorney in the San Diego office of RMO LLP, which he helped launch. He represents beneficiaries, as well as professional and corporate fiduciaries – e.g. administrators, executors, trustees, conservators, and guardians – in contested trust, estate, and probate litigation matters, as well as related estate administration issues. He also represents special needs / disabled students in special education, civil rights, and child abuse matters.
 
Specialized firms – including those practicing special education and nonprofit law – regularly seek out David’s expertise and creativity for complex state and Federal disputes, including appeals to the Ninth Circuit Court of Appeals and the California Court of Appeal.  David previously worked for the California Court of Appeal, the California Attorney General’s Office, and the U.S. District Court for the Southern District of California.
 
David graduated magna cum laude from the University of San Diego School of Law, where he was a member of the San Diego Law Review
 
Giovanna (“Gia”) Abreu O’Connor is a Senior Attorney and leads the Miami office of RMO, which she helped launch. Gia’s practice focuses on representing beneficiaries and fiduciaries—e.g., administrators, executors, trustees, conservators, and guardians—in contested trust, estate, and guardianship litigation, as well as related estate and guardianship administration issues. Gia also has meaningful experience in handling commercial and business disputes, real estate transactions and disputes, and appeals. Gia works closely with clients, resolving cases with efficiency and innovation and obtaining advantageous outcomes.
 
Gia grew up in Miramar, Puerto Rico and graduated from Florida International University with a B.A. in International Relations. She then attended Florida International University College of Law, where she served as a Dean’s Fellow to the Assistant Dean of Development, graduate assistant to Dr. Stanley Fish, and interned with the Probate Division of the 11th Judicial Circuit in Miami.
 
Tom Nanney is Of Counsel with RMO LLP and leads the firm’s Kansas City office.  In addition to his role with RMO, Tom serves as a Visiting Associate Professor at the University of Missouri – Kansas City School of Law.   Prior to his professorship, Tom was a litigator in private practice with a large, international law firm and an Assistant Attorney General with the Kansas Attorney General’s Office.  Tom’s practice with RMO focuses on counseling clients involved in disputed trust, estate and probate litigation as well as general business litigation.
