The presenters will discuss how social media platforms are designed to capture attention, elicit rapid fire responses (so-called “engagement”), and disseminate those responses quickly and permanently to a worldwide audience. But while these platforms convey several benefits for the practice of law, they also raise certain ethical considerations for attorneys. The presenters will cover the audience reach, ease of use, and low bar to entry associated with social media sites like – but not limited to – LinkedIn, Twitter, and Facebook. Then, the presenters will discuss how attorneys can use these opportunities to market themselves and their practices, and to engage in client development while carefully maintaining the professional standards for the practice of law and understanding that what attorneys post can be equally as harmful as it can be powerful. The presentation will cover the ABA Model Rules of Professional Conduct 1.1, 1.6, 1.7, 1.8, 1.9, 3.6, 4.2, 5.1, 7.1, and 7.2.
Blake Brockway is an Executive Principal, Associate General Counsel at Options Clearing Corporation, the clearing agency for listed equity options in the U.S. In his current role, Blake focuses derivatives regulatory matters.
Blake graduated magna cum laude from the DePaul University College of Law in 2009. He previously served as an Associate in the Financial Services Group at Katten Muchin Rosenman LLP, Vice President and Assistant General Counsel at Bank of America and Assistant General Counsel at NFA. Blake has written several articles and is a frequent speaker on a variety of topics related to financial markets and emerging technology. He is admitted to practice in Illinois.
James Sherer is chair of the Information Governance and Artificial Intelligence practice teams and also serves as a member of the E-Discovery Advocacy and Management, and Privacy and Data Protection teams. His work focuses on litigation; discovery management processes; enterprise risk management; records and information governance; data privacy, security and bank secrecy; artificial intelligence and algorithmic transparency; technology integration issues; and related merger and acquisition diligence. Prior to joining BakerHostetler, James worked as in-house litigator with a Fortune 500 company and previously practiced litigation in New York. He holds an M.B.A., his CIPP/US, CIPP/E, CIPM, FIP, and PLS data privacy professional credentials, the CIP and IGP information governance designations, the UCLA Extension Global Cyber Institute's Cybersecurity Certification, and the CEDS and CMLAW-EPC eDiscovery specialist credentials. James is also a member of The Sedona Conference® Working Groups One, Six, and Eleven; and writes and presents on e-discovery, information governance, privacy, investigation, and merger and acquisition issues.
Brittany Yantis’ developing practice focuses on international and data privacy-related litigation, electronic discovery, information governance, and technology application. She has authored articles focused on social media and related ethical considerations, and has performed deep-dive technological research in support of a variety of firm clients. Brittany has also assisted members of the BakerHostetler team representing Trustee Irving H. Picard for the SIPA liquidation of Bernard L. Madoff Investment Securities LLC.
