Description: With Democrats in control of the White House and Congress, companies can expect an uptick in antitrust enforcement and merger reviews and challenges complemented by a marked increase in legislative activity related to competition. This one-hour program will focus on antitrust priorities of the new administration and the expected increase in enforcement in several key industries, including tech, health care, and agriculture, over the next several years. Panelists will discuss the implications of President Biden’s recent appointments for competition policy going forward. They will also review various legislative reform proposals before Congress—from a sweeping overhaul of U.S. antitrust law to more modest bills targeted at protecting competition in key sectors—and the significance of these potential changes for companies across industries.
 
Susannah P. Torpey is Co-Chair of Winston & Strawn’s Technology Antitrust Group and a partner who litigates cutting-edge issues at the intersection of antitrust, IP, and technology. Susannah has more than 15 years of experience representing leading companies and competitors in the preparation, trial, and appeal of complex antitrust cases. Susannah regularly represents major corporations in high-profile, multidistrict, and class action litigation and government investigations involving a wide array of federal and state antitrust issues, including monopolisation, monopoly leveraging, price fixing, wage fixing, no-poach agreements, group boycotts, exclusive dealing, tying, price discrimination, unfair competition, anticompetitive product redesign, interoperability degradation, and mixed issues of antitrust and intellectual property law relating to Fair, Reasonable, and Non-Discriminatory (FRAND) obligations, standard-setting, patent licensing, patent misuse, and fraud on the PTO. Susannah also routinely counsels businesses regarding the minimization of antitrust risk, pricing strategies, antitrust compliance, and business issues relating to the use of tech and IP, many of which are key to a company’s global strategy. She has been repeatedly recognized as a ‘SuperLawyer,’ ‘Top Woman Attorney,’ and as a ‘Star’ in Antitrust and Litigation for obtaining critical wins for her clients, whether at trial on behalf of plaintiffs or by winning complete dismissals on behalf of defendants.
 
Jeffrey J. Amato is a partner in Winston & Strawn’s Global Antitrust/Competition and Complex Commercial Litigation practices.  He handles complex multi-forum disputes, principally in the areas of antitrust, class actions, and government investigations. Jeffrey is skilled in the use of expert evidence and data analytics to devise innovative legal strategies. Prior to joining Winston, he served as law clerk to the Honorable Arthur D. Spatt, U.S. District Judge for the Eastern District of New York.  Before his clerkship, Jeffrey was an attorney with the U.S. Department of Homeland Security, where he prosecuted numerous civil enforcement actions against individuals, air carriers, shippers, and other regulated entities.  During his tenure at the U.S. Department of Homeland Security, he received an interim appointment as Special Assistant to the Chief Counsel of the Transportation Security Administration.
 
Nasir Hussain is an associate in Winston & Strawn’s internationally recognized litigation practice. Nas has experience representing clients at all stages of litigation, with an emphasis on antitrust matters (both litigation and merger reviews), securities-related matters (litigation and government investigations), and other complex commercial disputes. Nas has extensive experience in litigation matters before both state courts and federal courts throughout the United States, and also represents clients in investigations by government agencies, including the U.S. Department of Justice, the U.S. Federal Trade Commission, and the U.S. Securities and Exchange Commission. He has also worked on merger control filings and reviews by several foreign antitrust authorities in multi-billion-dollar global transactions. Nas is a member of Winston & Strawn’s Health Care and Life Sciences Group and regularly serves health care clients in litigation and with regulatory matters, including counseling clients on matters involving state and federal controlled substances regulations. Nas also has considerable experience working with clients in a broad range of other industries, including manufacturing and financial services.
