Description: This summer has brought several noteworthy whistleblower developments that in-house counsel need to be aware of, including the Securities and Exchange Commission bringing its first anti-retaliation action and courts continuing to diverge on whether a plaintiff must disclose a suspected violation to the SEC in order to invoke the anti-retaliation protections of Dodd-Frank.  Join Bryan House and Courtney Worcester as they bring you up to speed on all the recent developments and provide practical tips for addressing such claims.

Bryan B. House, Esq. is a partner in Foley & Lardner LLP, where he is the chair of the Milwaukee Litigation Department, and a member of its Securities Enforcement & Litigation and Government Enforcement, Compliance & White Collar Defense Practices. Mr. House’s particular focus area is securities litigation, securities enforcement proceedings and whistleblower matters, and his experience includes representing public companies, investment banks and their directors and officers in class action litigation, and public and private companies, audit committees, special committees, officers and directors in connection with internal investigations and litigation brought by whistleblowers. A contributing author of the Securities Enforcement: Counseling and Defense treatise (Matthew Bender [last updated 2013]), his 2013 byline article, “Despite Confusion Regarding Key Whistleblower Statutes, Companies Must Be Prepared,” was published for the Wisconsin Chapter of Association of Corporate Counsel.

Courtney Worcester, Esq. is a partner in the Boston office of Foley & Lardner LLP. Her practice focuses on complex commercial litigation involving corporations, venture capital and private equity firms, financial institutions and their directors and officers. She has represented clients in corporate governance, federal securities and shareholder litigation matters, including federal securities and consumer class actions, stockholder derivative litigations, and internal corporate investigations. In addition, she is experienced in diverse commercial litigation matters, ranging from contractual disputes to the protection of trade secrets, unfair competition, and other business torts. She is a member of the firm's Securities Enforcement & Litigation and Private Equity & Venture Capital Practices. Ms. Worcester has been selected for inclusion in the 2007 – 2012 Massachusetts Super Lawyer – Rising Stars® lists.
