What is the general issue?  The webinar will address the principles and rules applicable to interpreting the terms and provisions in insurance policies.

Why is this important?  When analyzing a policyholder’s rights under an insurance policy, these construction principles are essential tools for obtaining coverage and avoiding the application of exclusions.   

Who will be most interested in this program?  In-house counsel, policyholders, and policyholder-side insurance coverage attorneys.  Insurance company attorneys and insurance-company-side insurance coverage attorneys may also be interested.  

What core concepts are addressed?  The webinar will address the following core concepts:  (i) how to identify an ambiguity; (ii) how to construe an ambiguity (contra proferentum); (iii) how to interpret defined terms; (iv) other construction principles (ex. general terms will be interpreted consistent with the specific terms they follow, the expression of one thing implies the exclusion of another, and a correct interpretation should render no terms or provisions meaningless), and (v) what materials and information should be considered when determining coverage.

What are the key learning objectives?  The key learning objectives are:  (i) understanding the insuring agreement; (ii) understanding the role of defined and undefined terms in the policy; (iii) understanding the applicability of exclusions; (iv) understanding burdens of proof in interpreting insurance policies; and (v) understanding the general principles of policy construction.
