Description: With the Internal Revenue Code now exceeding 74,000 pages, seemingly every action or inaction during life and upon death (and even well after death) has a corresponding Code section or Treasury Regulation. Many might assume that tax discussions should only be reserved for more advanced planning transactions. In practice, however, tax analysis is equally critical to all plans, even those that would otherwise be considered ordinary. This CLE will focus on various chapters of the Internal Revenue Code from a practice oriented approach, including Federal Estate, Gift, and Generation Skipping Transfer Taxation, and Federal and State income taxation. Topics of discussion, to name a few, will include tax consequences relating to the funding of revocable and irrevocable trusts, the various tax characteristics of an "A-B split" trust, advising clients regarding the differences between the progressive tax brackets of irrevocable trusts versus individuals, the impact of provisions within Wills and Trusts on the sale or distribution of assets, and when tax benefits might take a back seat to more important family matters.
