Description: The legal landscape in the United States has been significantly influenced by the rapid technological advancements of the past decade. From the widespread adoption of email, laptops, and smartphones to the emergence of generative AI tools and large language models, technology has revolutionized how legal professionals work and interact with the law.
 
This CLE presentation will provide an overview of the intersection of artificial intelligence and attorney ethics. Lawyers will develop a deeper understanding of how the Model Rules of Professional Conduct, such as Rule 1.1 (Lawyers Duty of Competence), and Rule 1.3 (Diligence), intertwine with AI and the ethical use of technology.
From Supreme Court pronouncements commenting on generative AI to circuit courts requiring certifications regulating AI use, the presentation will contemplate the complexities of navigating this landscape and how lawyers can uphold their ethical obligations.
 
 
Presenter Bios
 
Drawing upon decades of experience as a trial lawyer and trusted counselor, Fran Green counsels’ global clients on navigating the complexities of workforce management, cybersecurity, and data privacy laws, as well as the opportunities and legal risks presented by the design and deployment of artificial intelligence in consumer tools and within the employment life cycle.
 
 
Fran’s experience includes:
 
  • Guiding corporate compliance and risk assessment executives through the creation and implementation of data and information privacy programs and policies, with a particular focus on the use of disruptive technologies and artificial intelligence. She holds a Master of Laws in Cybersecurity and Data Privacy from Drexel University Thomas R. Kline School of Law.
  • Advising management and corporate boards of multinational and domestic corporations on all aspects of employment law.
  • Litigating on behalf of domestic and global financial institutions and corporations in federal and state courts and before various federal securities exchanges in all aspects of workforce management.
 
Conversant in Japanese, having studied and worked in Japan as a vowed nun, Fran has presented before the Keidanren (Japan Federation of Economic Organizations) in Tokyo and Osaka, the Japan Society, and the Japanese Chamber of Commerce and Industry on the subject of corporate localization in the United States and the attendant legal issues in doing business within the United States and attendant risks and issues, among them cybersecurity and privacy.
 
In 2010, Fran joined Michelle Obama, J.K. Rowling, Barbara Walters, Maya Angelou, Suze Orman, and other women leaders as a contributor to The Goddess Shift: Women Leading for a Change, edited by Stephanie Marohn and published by Elite Books. In connection with the book’s publication, she was featured on FOX News's popular "FOX & Friends" morning television show, along with Oscar-winning actress Olympia Dukakis, to discuss the chapters they contributed. In November 2010, the book won the USA Book News "Best Books 2010" award in the Women's Issues category and was a finalist in the Anthologies Nonfiction category. Royalties from the sale of the book continue to be used to support non-profit organizations dedicated to improving the lives of girls and young women: Capacitar, Tostan, and the Global Fund for Women.
 
Currently, Fran serves on the Advisory Council of the Japan Society Board of Directors and is an Advisory Board member of Corporate Counsel Women of Color. She was also a Board of Directors member of the Grace Institute and is a cofounder of Epstein Becker Green’s Women’s Initiative. In addition, Fran is an award-winning equestrian and was privileged to serve within the New York City boroughs as an Auxiliary Mounted New York Parks Officer and on the Board of the New York City Parks Mounted Auxiliary, a 501(c)(3) foundation supporting the New York City community and the New York City Parks Mounted Enforcement Unit. Fran enjoys indoor and outdoor rowing and racing and has medaled in the Indoor U.S. and World Rowing Championships.
 
 
Litigation attorney Rebecca Porter works closely with national and regional clients to design and carry out the litigation strategies that meet their unique business concerns.
 
Rebecca represents health care, life sciences, and commercial organizations in federal and state court litigation and arbitrations on matters including antitrust, contract disputes, and business torts. In addition, she provides clients with advice and solutions on matters relating to artificial intelligence (AI) and the Internet of Things (IoT), including those involving data-driven government initiatives, AI-driven technologies, smart cities, algorithms, open government data, and the data value chain.
 
Before joining Epstein Becker Green, Rebecca served as a Judicial Law Clerk for the Honorable Carmen Messano, the Presiding Judge of the New Jersey Superior Court, Appellate Division. During law school, Rebecca was a Fellow at the Rutgers School of Public Affairs and Administration’s Transparency and Governance Center, where she studied issues relating to the intersection of data and discrimination. Also while at law school, she interned at the Department of Homeland Security, volunteered at the South Jersey Legal Services Expungement Clinic, and was an intern for the Honorable Judge Joseph A. Dickson of the U.S. District Court for the District of New Jersey.
