PROCESS AND PROJECT MANAGEMENT: ARE YOU READY?

This session will examine what to do about process and project management when electronic discovery comes knocking. Do you have a process in place to manage data from identification through presentation? Do you have a method to hand off data? Do you know what your costs have been or what they will be? How do your approaches differ if you have a de-centralized process vs. a tightly controlled one? What do smaller organizations need if they do not have internal resources to support a well defined process?

ETHICAL ISSUES: BEWARE OF THE CAMOUFLAGED THORNS

With electronic discovery, the already thorny issue of conflicts draws even more blood. Established guidelines inform traditional conflicts issues – the ones between law firms and clients. Attorney competence, candor with the tribunal, and conflicts of interest are some of the challenging topics. Add service providers to the mix and everything becomes even less clear. This discussion will address who owes what duties to whom, under what circumstances they owe those duties, and how those obligations can be met. If that were not enough, there is the issue of what to do if the relationship goes sour, something the panel will address as well.

There are many ways to handle an electronic discovery case- but the key is to right-size both the technology and the legal team. Too much technology can become unmanageable. A big legal team put on a small matter can push costs so high that the business’ bottom line is jeopardized. Yet, too little technology or too small a team also can lead to disaster. This panel of experts will discuss methods to decide what is needed in the different stages of a case, from the theoretical calm of pre-litigation planning to the scramble of handling a bet-the-company case.

Value and Cost are inherently intertwined and they need to be addressed together as well. However, often times “Value” is discussed as a stand alone item, unrelated to costs. The same holds true for “Cost”. But Value and Cost only have meaning when each is examined through the other’s prism. This wrap up session will focus on key tips and techniques for adding value and controlling costs, finishing with a rapid-fire 15 tips in 15 minutes to send you on your way with some final practical pointers.
