Description: This podcast will provide attorneys with a foundational understanding of Abatement Actions in Litigation. This session will explore what is abatement, historical development, modern statutory construction, particular grounds for abatement, real life examples/personal experiences, and recommendations when someone should engage a lawyer. 

 
Shannon Smyth-Mendoza has been practicing law in Santa Clara and San Mateo Counties for almost 24 years.  She joined the Office of the General Counsel for the Santa Clara Valley Transportation Authority (VTA) as Senior Assistant Counsel in March 2019 and handles transactional and litigation matters. Shannon worked in the Office of the Santa Clara County Counsel, building their Code Enforcement Section for almost 3 years, and spent the majority of her career in the City Attorney’s Office for the City of San Jose.  She handled affirmative litigation and defended personal injury, dangerous condition of public property, labor and employment, civil rights, and other constitutional law cases against the City for 15 years in federal and state court.  As lead counsel, she tried dozens of jury, court, and administrative matters.  Early in her career, Shannon spent four years with the Office of the San Mateo County District Attorney, Family Support Division, where she prosecuted child-support and paternity actions.  Shannon has briefed and argued before both the Ninth Circuit and Sixth District Court of Appeal.  Since 2020, Professor Smyth-Mendoza has taught torts to first year law students.

Shannon has a son who graduated from the University of Oregon and is a music teacher/musician in Portland and a daughter, who is studying business and a scholarship athlete at Cal Poly, San Luis Obispo.  Shannon lives in Willow Glen with her husband, dog, and turtle and enjoys kick boxing, yoga, biking, hiking, and travelling.
 
Kevin S. Lee, JD, MDiv, is the Building Management Administrator for the City of San Jose. He has been in the legal profession for more than 25 years, working as a Senior Litigation Legal Analyst — specializing in intellectual property and general business litigation with several prominent law firms — and as a Legal Support Manager at the City of San Jose Attorney’s Office. Kevin received his bachelor’s degree in criminal justice from Northeastern University. He earned his JD from the University of the District of Columbia School of Law. He also earned his master’s degree from Fuller Theological Seminary. Additionally, he served as a board member for the Association of Legal Administrator’s (ALA) Silicon Valley Chapter and ALA’s National Chapter Resource Team. He is currently a member of ALA’s Board of Directors and a member of the American Bar Association.
