Description: Multinational companies and United States-based service providers have long struggled with transferring information from the European Union to the United States, and balancing legal compliance with practical need. With the invalidation of the Safe Harbor in 2015, the struggle became even more difficult. Although there remains uncertainty concerning how long the different methods for transferring information will continue to be recognized, with the approval of Privacy Shield, we have finally reached at least a temporary period of stability. This program covers the legal and regulatory issues involved with transferring information from the European Union to the United States, and discusses the three methods that are recognized for doing so: the Privacy Shield, standard model clauses, and binding corporate rules.

David A. Zetoony, Esq. is a partner in the Washington, D.C. office of Bryan Cave LLP. Mr. Zetoony is the leader of his firm's data privacy and security practice, and has extensive experience advising clients on how to comply with the advertising and data privacy rules and regulations of the Federal Trade Commission. He is an International Association of Privacy Professionals (“IAPP”) member, and he sits on the ABA Section of Antitrust Law’s Private Advertising Litigation Committee (former Vice-Chair); and the ABA Section of Antitrust Law’s Healthcare and Pharmaceutical Committee (former Consumer Protection Vice-Chair). He frequently speaks and writes on data security and privacy issues.
 
Carolyn Krampitz, Esq. is an associate in the Hamburg office of Bryan Cave LLP. Her practice focuses on cross-border international trade and compliance law, including export controls and economic sanctions. She advises public and private companies on how to develop corporate trade compliance and training programs when dealing with trans-border business issues in Germany and the European Union (EU), as well as the analysis, optimization and support of implementing processes according to the national legal requirements. She has been a member of the German Bar since 2008.
