Even though the sub-prime mortgage market came to an end in 2008, Massachusetts is still dealing with the aftereffects of a large number of residential foreclosures and bankruptcies that have caused some homeowners throughout the state to abandon property. The causes and effects of, and remedies for, abandoned property have a profound impact on municipalities, the housing courts, and communities. Attend this timely session to gain an understanding of nuisance law as well as the statutory remedies for abandoned property. In addition to providing an overview of the receivership statute, M.G.L. c. 111, sec. 127I, learn about the mechanics of receivership, how to fund a receivership, and the rights and duties of receivers and property owners, including how to foreclose or terminate a receiver's lien.
