Description:
This program will provide an overview of significant developments in the practice of elder law. Experienced practitioners will discuss the viability of assisted living residences such as nursing home alternatives and the available types of assisted living options including profit, non-profit, and SSI/Medicaid funded facilities and programs. An update on the implementation of mandatory MLTC for duals in NY will be provided, including new policies regarding internal appeals, aid continuing, assessment in nursing homes, spousal impoverishment, and mandatory nursing home enrollment. A preview of the FIDA demonstration beginning in the fall will also be provided. The new Uniform Adult Guardianship and Protective Proceedings Jurisdiction Act will be covered with a particular focus on suggested language regarding jurisdiction that can be included in guardianship petitions.
