Description: Ken McClain is one of the most prolific and successful trial lawyers in the country. With over one billion dollars in verdicts and settlements, his courtroom results are virtually unparalleled. In this presentation, Mr. McClain will take the listeners through one of the most ground-breaking cases in modern trucking litigation: James Garrett, et al. vs. George Albright, Jr., et al. A common theme throughout the trucking industry these days are corporate shell games and third party logistics companies. These entities exist to shield money earned through a trucking operation and prevent victims from obtaining fair compensation in the event of a wreck. By using alternative theories of recovery such as broker/shipper liability and alter ego liability, Mr. McClain has been able to expose some of most complex trucking enterprises in the country and obtain extraordinary settlements and verdicts for his clients. The seminar will teach the listener the fundamentals of the modern trucking conglomerate and how to pierce the veil.
Kenneth B. McClain is a shareholder in the Independence, Mo., law firm of Humphrey, Farrington & McClain. He has practiced law since 1982, and joined his current firm in 1985. He received his law degree from the University of Michigan, where he served as an editor of the Journal of Law Reform. He is a nationally recognized trial lawyer. Ken has obtained one of the top 100 verdicts in the country in six of the last ten years. He specializes in complex toxic and mass tort litigation. Over the last two decades, Ken has been awarded verdicts and has negotiated settlements totaling more than $1 billion on behalf of clients throughout the nation.
In 2008, Ken was the lead attorney in the record setting tractor-trailer collision wrongful death lawsuit, Garrett vs. Centra. The case went to verdict, where the jury awarded $15 million on behalf of the deceased family members. Following the actual damage award, the case was settled for $18 million to avoid a punitive damage verdict. Additional members of the same family went to trial in 2010 in the case of Gibbs v. Centra. The jury awarded in excess of $35 million to the survivors of those killed in the collision.
