Description:
R. Mark Halligan will discuss recent legal developments in trade secret law including recent cases in both state and federal courts.   He will also provide an update on the likelihood of amendments to the Economic Espionage Act to add a federal civil cause of action and ex parte seizure provisions to the EEA.  In addition to U.S. developments, he will also review worldwide developments in trade secret law including the proposed EU Trade Secrets Directive.
 
Mr. Halligan will discuss recent legal developments in trade secret law, including review of business-essential trade secrets cases regarding reasonable efforts to protect information so that courts award trade secret protections. He will also cover the status of and prognosis for the proposed Federal trade secrets law.  Also covered will be employee conversion of trade secrets case study in the DuPont/Kolon case, as well as protecting trade secrets in cases of Freedom of Information Act requests of government entities in the event of government contracts in view of escalated FOIA press requests and coverage.
 
Ms.Lisa Brownlee will discuss legal ethics aspects of trade secrets protection, including invocation of attorney-client privilege over subpoenas for cybersecurity standards and practices, as recently enunciated in Genesco v. Visa. Her presentation will outline best practices and policies for information security legal staffing to maximize privilege/work product protection.
