From the plaintiffs’ perspective, lien issues must be considered shortly after a claimant retains the services of a law firm. From the defense perspective, information is gathered throughout the discovery process to obtain information regarding claimants’ Medicare/Medicaid status, the potential existence of lien holders related to health care payments, amounts paid by Medicare/Medicaid and/or owed to health care lien holders, to allow clients to verify claimants’ Medicare status and to assess potential lien recovery risks.
As the law and procedures in this area continue to evolve, attorneys need to keep abreast of recent developments. The program will focus on best practices with respect to considering lien issues over the life of a claim.
