The discussion addresses how Western commercial companies and investors should deal with REXIT: how to leave Russia in anticipation of the inevitable international contract disputes, arbitration and settlement. Speakers will include attorneys from the U.S., Russia, and Western Europe.
The program will begin with an update (and practical assessment) on navigating sanctions, counter-sanctions, financial restrictions, and other hurdles for Western companies seeking to leave Russia. This includes the Biden Administration’s Executive Order No. 14071 (April 6, 2022) and its restriction on professionals engaged business consulting, mergers & acquisitions, and other transactional practice in Russia. Other updates will address dealings with sanctioned Russian Banks (and others on the “SDN” list), cross-border currency exchange, sanctions’ relief, and other hurdles.
The program will also address practice pointers for transactional attorneys, arbitrators and litigators seeking to resolve Western-Russian contractual disputes, the respective jurisdictional interpretations of “force majeure,” investment arbitration, choice of law /forum considerations, settlement considerations and (for future transactions) deal protections.
