Description: The Supreme Court & Legislative Panel of the JPPCLE seminar presented three important cases with a special presentation from the Honorable Richard Linn of the United States Court of Appeals for the Federal Circuit who highlighted a case American Axle v. Neopco, recently accepted for Supreme Court review.  American Axle, as Judge Linn explained, has the potential to further expand the exceptions to patent eligibility to certain mechanical devices. We discussed the Supreme Court’s recent decision in Google v. Oracle which held use of Google’s use of Java declaring code was considered a fair use under the copyright laws. Also, the Supreme Court’s decision in Arthrex v. Smith & Nephew was discussed which addressed whether administrative patent judges are properly appointed. Finally, we discussed the case of Immunex v. Sandoz which the Supreme Court declined to take up but related to the standards used for determining common ownership when determining the obviousness-type double patenting.
