Description: This practical webcast will discuss many of the key considerations to be made in the context of an internal investigation as it relates to employees. We will discuss some of the best practices for internal investigations, and the many questions an employer must answer in undertaking an internal investigation, which are often dependent upon the size, scope, and severity of the claims. The educational objectives of this webcast include: 1) Understanding of some of the key considerations for employers when complaints  arise in the workplace; 2) Familiarity with many of the factors that come into play during an internal investigation, including issues of privilege, confidentiality, and the legislative frameworks by which investigations are governed; and 3) Awareness of potential  steps to take for minimizing risk.

  • WHO should conduct the investigation? What factors should be examined in determining whether an investigation should be conducted by an internal HR or legal team, external  law firm, or third-party investigator? What role should privilege play in these determinations? 
  • WHAT are some "best practices" in conducting an internal investigations? What is the legislative framework for when complaints arise in the workplace, and what  should be included in your employee handbook under city, state, and federal laws regarding investigations and non-retaliation? 
  • WHEN should the investigation begin? When should you initiate an investigation and when should you notify insurance carriers? 
  • WHERE  should the interviews take place? What can you do to help keep the process as confidential as possible?
  • HOW do you deliver the findings? Who should receive the findings, and what format should they take?
  • WHY is it important to conduct effective internal  investigations? What role do investigations play if litigation is to arise?
