Description: Mark Labine will give a summary of the most common types of cases in Housing Court, including 1)evictions for non-payment of rent, breach of lease, holdover, mortgage foreclosure or cancellation of a contract for deed, 2) rent escrow, 3) tenant remedy actions, 4) emergency tenant remedy actions, 5) unlawful lockouts, 6) rule 60.02 motions to quash writs, and 7) expungements. He will discuss who the District Court partners with in addressing these housing issues, and will discuss the legal issues, including the legal defenses available to defendants, in all the above actions. He will also briefly discuss how to appeal a housing court decision, either through a request for a judicial review of a referee decision, or an appeal to the Minnesota Court of Appeals.
 
All persons attending the CLE will received a copy of Mark’s powerpoint and a copy of his Bench book which consists of 218 pages and includes 110 issues involving housing law. 

Mark Labine, graduated from the University of Minnesota in 1977 with a B.A. in Sociology and his J.D. from Hamline University School of Law in 1980.  From 1970 to 1974 he served in the U.S. Navy as an Air Traffic Controller and is a Vietnam Veteran.  He practiced law with Dudley and Smith P.A. and Moriarty Janzen and Labine, P.A. before starting his own general law practice in the St. Anthony Park neighborhood of St. Paul in 1991. He worked part time as a contract Administrative Law Judge, Arbitrator, Magistrate, Referee and Mediator until June, 2005 when he appointed to be the full time Housing Court Referee for Hennepin County District Court where he presided over Family, Housing and Harassment cases.
