These extraordinary times are forcing small businesses, many for the first time, to consider the forms of relief that bankruptcy law provides.
These businesses are newcomers to bankruptcy, and so are many of the lawyers, accountants, and other professionals who advise them on legal, financial, and other business matters. To assist these professionals in advising their clients, this course provides an introductory overview of small business liquidation and reorganization under the federal Small Business Reorganization Act of 2019. This Act went into effect in February 2020, just before the COVID pandemic.

This newest form of small business reorganization is increasingly important, as will be its impact on the predicted small business bankruptcy tsunami. Relief under the Act is intended to be faster, cheaper, and less bureaucratic than regular Chapter 11; but to understand whether it is right for a client, professionals must understand certain bankruptcy fundamentals.

This course introduces the concepts and tools generally available in any bankruptcy case, regardless of the type of debtor or the type of relief sought. This includes the different forms of bankruptcy, which vary based on eligibility and the nature of relief sought by the debtor. These tools can help clients in fighting to keep their businesses alive and growing as long as feasible or, alternatively, help clients in winding down the business as efficiently as possible now in order to start again later.

Who Should Attend

Like all of the programs in this Wake Forest Law/Thomson Reuters Small Business Bankruptcy series, this course is designed for and targeted at lawyers, small business owners, accountants, paralegals, and other experienced professionals who are new to bankruptcy and want practical, real-world advice from judges and practitioners to help them advise clients.

They will talk among themselves and swap experiences and ideas to show how bankruptcy works generally and how it works differently depending on the client’s peculiar circumstances, needs, and interests.
