The structure and demands of the legal profession create an environment that invites unhealthy coping strategies. According to the American Bar Association, “the current state of lawyers’ health cannot support a profession dedicated to client service and dependent on the public trust.”
In this hour, we look at the issue of substance abuse from the point of view of those who are in positions of management responsible for monitoring other attorneys. What is the best way to approach such a situation? What are the ethical responsibilities of lawyers under these circumstances? How can attorneys identify and address problematic behaviors in colleagues before they become career damaging, or worse yet—career ending?
This program will discuss recognition signs and symptoms, barriers to treatment along with ethics violations. ABA Model Rule 8.4 (b)-(d), 8.3 (a), ABA Formal Opinion 03-429 and more.
