Description: Ethical problems can come up even for the most diligent practitioners, across all practice areas.  Family law, given its emotionally charged nature, is especially ripe for ethical problems, complaints, and disciplinary actions.  Attorneys Jeremy Levinson and Stacie Rosenzweig will address how to avoid ethical problems, and what to do when an attorney is faced with a potential or actual violation of the rules of professional responsibility.

Potential Problem Area: Communication and Diligence (12:35 p.m.)
 What does “reasonable promptness and diligence” and “reasonable communication” mean in a family law context? (SCR 20:1.3, SCR 20:1.4(2)(-(4))
 What happens when the client wants to control everything? (SCR 20:1.2, SCR 20:1.4(5))
 What happens if the client wants to do something illegal? (SCR 20:1.6 (b), SCR 20:1.4(a)(5))
 What happens if the client reveals child abuse is occurring? (SCR 20:1.6 (b)-(c))

Potential Problem Area: Conflicts of Interest (12:50 p.m.)
 Can you represent someone in a divorce if you’ve represented them, or their family, or their business, in other matters in the past? (SCR 20:1.8, 1.9)
 What happens when a pro se spouse asks you for help? (SCR 20:4.3, SCR 20:1.7)
 Can you have a business or a personal relationship with your client during, or after the divorce? (SCR 20:1.8)

Potential Problem Area: You’ve made a mistake (or the client thinks you did…) (1:05 p.m.)
 When is it necessary to inform your client you made a mistake? (SCR 20:1.4, “What to Do After Making A Serious Error,” Pierce & Anderson. Wis. Law. Feb. 2010.)
 What happens if a client makes a complaint against you? (SCR 22, SCR 20:1.16)
