Description: One of the many important aspects of the Defend Trade Secrets Act of 2016 is that it added theft of trade secrets in violation of 18 U.S.C. §§ 1831 and 1832 to the list of acts of racketeering upon which a federal RICO claim can be predicated.  This course will discuss RICO’s application to theft of trade secret claims under sections 1831 and 1832.  Rather than bootstrapping a trade secret claim into RICO through the use of the mail and wire fraud statutes, which federal judges always viewed with suspicion, anyone who engages in a pattern of trade secret theft will now face liability under RICO.  This liability will extend not only to those who get their hands dirty, but will also extend to those who operate from the shadows.  The primary advantage of a RICO claim is that it extends liability to “operators and managers” and conspirators who have traditionally be able to insulate themselves from court action.  This broader liability for the theft of trade secrets could enable victims to reach governments who promote economic espionage or multi-national corporations who finance the operations of hackers and other cybercriminals.  Join us for an exploration of these and many other topics related to the marriage of RICO and the Defend Trade Secrets Act of 2016.
