Description: Section 337 investigations before the U.S. International Trade Commission provide a right of action for companies to challenge the importation of goods based on infringement of U.S. intellectual property rights or other unfair acts in the importation of goods. Section 337 litigation provides worldwide discovery, expedited hearings, and judges with expertise in intellectual property and unfair competition law. Section 337’s effective remedies – an import ban enforced by U.S. Customs and Border Patrol on infringing products and national cease and desist orders barring the domestic sale and distribution of imported products – are in many cases more powerful than those available in U.S. district court, where injunctive relief can be very difficult to obtain.
