Description: Prehearing e-discovery procedures vary greatly in arbitration, depending on the agreement of the parties, the sponsoring organizations and their rules, the predilections of the arbitrators, and of course, the circumstances of the case. Parties usually choose arbitration in part to avoid some of the cost and burden of discovery devices in ordinary civil litigation. Panelists would thoroughly examine the AAA's "Commercial Arbitration Rules" (The AAA Rules), and the Judicial Arbitration and Mediation Services(JAMS) Rules that cover preliminary conferences, formats of production, metadata, custodians and cost shifting. Attendees will also receive valuable insight and suggestions on how to manage e-discovery spend and risk when involved in a AAA or JAMS dispute.
