Description: In recent years, both the Federal Energy Regulatory Commission (“FERC”) and Commodities Futures Trading Commission (“CFTC”) have become increasingly aggressive in pursuing enforcement actions against entities that it views as manipulating markets subject to its jurisdiction.  The result has been the assessment of larger civil penalties against entities that find themselves in the crosshairs of these agencies and record levels of litigation involving the scope of these agencies’ manipulation authority.
