Description:
New options for obtaining and enforcing patents in the EU are expected as soon as Spring 2014. The European Union has adopted two resolutions to create a Unitary Patent for most EU states, with reduced translation costs and more efficient post-grant procedures. All but two of the 27 EU states are expected to sign a Unified Patent Court Agreement in February 2013. As a result, following ratification, the new court system will be an option for enforcement of European Patents, including Unitary Patents. European Patent applications now on file may qualify to become Unitary Patents and may be litigated in the new court system. Therefore, planning for future patent protection in Europe should begin now.

The speakers are Frank D. Peterreins, Managing Principal of the Munich office of Fish & Richardson P.C., and John B. Pegram, who is a Senior Principal in the firm's New York office. Frank is a German attorney-at-law, and a European and German patent attorney. John is a U.S. attorney-at-law and registered patent attorney. He is a member and former chair of the US Bar-EPO Liaison Council. Both have extensive experience of advising U.S. clients in European patent matters. 

This webcast will explain the Unitary Patent and Unified Patent Court system, and help you plan and budget your patent protection program in the EU. Topics will include: 

o What is the Unitary Patent? 

o The role of the European Patent Office.

o Patenting options in the EU,  including either a Unitary patent or national patents via the EPO, and direct-filed national patents.

o The Unified Patent Court system, including both the Central Division and the local divisions

o Factors affecting your patent and court choices in the EU, including costs and flexibility, initially and throughout the patent’s life

o Transitional provisions in the early years for both the Unitary Patent and Unified Patent Court system
