Description: In this program, we will explore the different roles lawyers play in the live entertainment industry. We will discuss a lawyer’s ethical obligations to putative clients (and consider the definition of who constitutes a “client,” the representation of multiple clients’ interests, and the associated pitfalls of such representation). We will address the different responsibilities lawyers have in navigating the interplay between the business side of the entertainment industry and the legal obligations upon a lawyer.
 
Participants will have a greater understanding of the ethical considerations under the ABA Model Rules of Professional Conduct, and how to avoid running afoul of the rules. Participants will be apprised of some of the dilemmas and dangers for lawyers, managers, executives, agents, and others when acting on the ethical stage.
  
Presenter Bios 
 
Carla Varriale-Barker is an accomplished litigator who is at home in a courtroom, board room or classroom. She represents a portfolio of clients in the sports, recreation, amusement and hospitality industries with a client-centered practice focusing on tort, discrimination, contract, insurance and premises liability matters, including the defense of claims arising from alcohol service, security lapses, discrimination in places of public accommodation, sexual abuse and molestation.
 
She is chair of the firm’s Sports, Recreation & Entertainment practice group.
 
Carla counsels’ clients involved with the U.S. Center for SafeSport, an organization established by Congress to address sexual abuse, bullying and other misconduct, and the U.S. Olympic and Paralympic Movements. She is an adjunct instructor at Columbia University’s School of Professional Studies where she has taught in the Sports Management Program since 2008.
 
Prior to joining Segal McCambridge, Carla was a founding partner of a women-owned law firm. She has also written for the American Bar Association about diversity and inclusion and the importance of mentorship and sponsorship.
 
Carla earned her J.D. from New York Law School where she was part of the Order of the Barristers and the Moot Court Executive Board. She holds a B.A. from Boston University. 
 
Devika Kewalramani is a Partner and Leader of Moses Singer's Law Firm Industry practice which advises law firms, lawyers and legal departments on ethical and legal aspects of law practice. She also currently serves as the Firm's general counsel. Devika represents law firms and attorneys in legal ethics, professional responsibility, law firm risk management, lawyer licensing and admissions matters, including escrow issues, conflicts of interest, structuring arrangements with non-lawyers, multijurisdictional practice, disqualification, lateral transition, law firm mergers and break-ups, partner disputes, ethics in alternate dispute resolution, reporting/disclosure issues, attorney advertising, law firm cyber security issues, social media use, legal fee disputes, and other professional ethics issues.  She conducts ethics and risk management audits for law firm clients.
 
Devika has been appointed by the New York State Supreme Court, Appellate Division, as a member of the Attorney Grievance Committee for the First Judicial Department.
 
She currently serves as a Vice President of the New York City Bar Association, and she previously chaired the Board of Directors of the New York City Bar Association from 2022 to 2023.
 
Devika served as a member of the New York State Bar Association’s Restarting the Economy Work Group in 2020 which worked to develop guidance for re-opening law firms in New York State.
 
She was appointed a member of the New York Commission on Statewide Attorney Discipline in 2015 and served as a Co-Chair of its Subcommittee on Transparency and Access.
 
A frequent lecturer, panelist and author on legal ethics, Devika speaks to law firms, corporate legal departments, bar associations and professional groups on a variety of legal ethics matters. She has served as a faculty member of the Practising Law Institute and of Lawline.com.
 
From 2014-2022 Devika achieved Super Lawyer status in the Metro Edition of New York Super Lawyers®.
