Description: This program will discuss limitations in existing law and examine innovative ways to bring civil claims against intimate partners in sex abuse cases. Existing law provides a remedy for victims of forced sexual abuse, but options are often limited for victims who are coerced into sexual relationships through nonphysical means.
This program explores those situations where abusers obtain supposed consent using drugs, lies, grooming tactics, and other forms of manipulation, and seeks to offer two potential avenues for redress. First, we look at an emerging trend in the law that has successfully used the Trafficking Victims Protection Act and RICO against perpetrators who have abused multiple intimate partners. Second, we explore the potential consequence of repealing antiquated state laws known as “anti-heart-balm” statutes.
Annie Martin-McDonough is an Intake Attorney at Kabateck LLP. Annie has extensive experience handling the intake process, including researching, evaluating, and helping to advise firm leadership on the legal and financial viability of potential new cases, and drafting retainer agreements, joint prosecution agreements, and letters to potential clients.
Before joining the firm, Annie gained legal experience while serving as a legal intern and student mediator for the Loyola Center for Conflict Resolution. She handled various tasks, including in-depth intakes on client conflicts, consumer debt, landlord-tenant, and divorce disputes. Upon completing his clinical mediation externship, Annie received a Mediation Certificate, satisfying the California Dispute Resolution Programs Act.
Annie received her law degree from Loyola Law School in 2021. While attending Loyola’s evening program, Annie worked full-time as a compliance manager in the alcoholic beverage industry where she gained experience conducting legal research and drafting legal documents under the supervision of in-house counsel. Before law school, Annie served as a committee research director for the Massachusetts State Legislature. During this time, she researched policy and analyzed proposed legislation concerning consumer protection and professional licensure.
Anastasia Mazzella is a seasoned litigator with expertise in employment litigation, class actions, mass torts, personal injury and consumer protection laws. In addition to managing a caseload, she works closely with the Managing Partner and the Management Team to develop and implement firm policies, practices, procedures, staffing, and oversees the law and motion practice and intake department.
Prior to joining Kabateck LLP, Ms. Mazzella spent five years as a litigator at a civil defense firm where she focused on motion and appellate work. As a defense litigator, Ms. Mazzella researched, drafted and successfully argued over one hundred motions and briefs, in both state and federal courts, in a variety of areas, including products liability, employment, business litigation, professional liability and consumer protection laws. Ms. Mazzella served as a judicial extern for the Honorable S. James Otero of the United States District Court during law school and as Editor in Chief of the Loyola Law Review.
Ms. Mazzella most recently helped secure a confidential six-figure settlement from Clayton Valley Charter High School on behalf of a female student who was sexually assaulted by a male student on the school’s campus. In addition, she has also helped secure a $1,350,000 settlement on behalf of a young mother who was catastrophically injured after her car was hit by Riverside Transit bus. In a case involving catastrophic injuries, Anastasia reached a $925,000 settlement on behalf of her client who was injured after an employee of Hylkema Roofing Company struck her vehicle.
In cases involving school sexual assaults, Anastasia represented a female student who was assaulted by a male student at the Animo Venice Charter High School campus. She also represented a student who was sexually abused as
