Description: The Environmental, Social and Governance (“ESG”) and sustainability movements have placed increased attention on corporate environmental benefit claims and disclosure statements. In response, new regulation and litigation have emerged pertaining to "greenwashing"—a marketing practice that involves unsubstantiated or exaggerated benefit claims about a product or service and their associated environmental and climate change impacts. Greenwashing can also occur in corporate disclosure statements, influencing financial analyses and investor strategy.
 
This panel will address each of these pressing issues, including recent developments in case law, pertinent regulations, and suggested mitigation strategies, from the perspective of both inside and outside legal counsel.
 
Presenter Bios 
 
Alice Douglas is a litigation associate with Manko, Gold, Katcher & Fox, LLP.  She came to the firm after serving as a law clerk to the Honorable Robert O. Baldi in the Bucks County Court of Common Pleas.
 
Alice graduated cum laude from Villanova University Charles Widger School of Law where she received a Dean’s Merit Scholarship and completed a concentration in litigation and dispute resolution.  During law school, Alice was a legal intern for the U.S. Environmental Protection Agency Region III and President of the Environmental and Energy Law Society. Additionally, Alice was an executive member of the Villanova Law Moot Court Board and advanced to the final round of the 60th Annual Theodore L. Reimel Moot Court Competition where she argued before the Honorable Susan P. Gantman of the Pennsylvania Superior Court, the Honorable Barry T. Albin of the New Jersey Supreme Court, and the Honorable Marjorie O. Rendell of the United States Court of Appeals for the Third Circuit.
 
Alice attended Davidson College for her undergraduate degree in Environmental Studies with a minor in Health and Human Values. She graduated cum laude and received departmental honors.
 
Outside the office, you may find Alice reading, running, cooking or traveling and using her photography skills to capture her adventures.
 
 
Tanya Nesbitt, Esq. specializes in helping businesses in heavily regulated industries such as energy, refining, chemicals, forestry and mining. She works on her clients’ issues as if they are her own while managing the process and helping them to solve issues quickly and avoid shutdowns.

She collaborates with all her clients to find the best business solutions, whether it involves providing detailed strategic advice and tactics, counsel on the advertising and marketing of environmental benefit claims, or fighting for her clients in litigation.
 
Tanya has represented small to sophisticated businesses in environmental permitting, natural resource and land management and wildlife management in relation to federal public lands. Her experience includes working with the U.S. Department of Justice’s Natural Resources Division, the Bureau of Land Management and Forest Service in Greater Sage-Grouse litigation as well as working as an Assistant United States Attorney for the U.S. Attorney’s Office in Washington, D.C.
 
 
Jonathan Nwagbaraocha is Environment, Health, Safety & Sustainability Counsel and Compliance Leader for Xerox Corporation and Chief Compliance Officer for Xerox Healthcare, LLC.  He advises on various environmental, health, safety, and sustainability matters throughout operations as well as related areas within supply chain and procurement and enterprise governance on a global basis. As Compliance Leader, he ensures that the organization is in full statutory compliance with applicable laws and requirements in our industry as well as internal policies. He is also serving as Chief Compliance Officer for Xerox Healthcare, LLC.  In these roles he uses his experience, practical compliance knowledge, and project management skills to provide legal advice and design innovative compliance processes.  He holds a B.A. in Environmental Science and Policy from Duke University, an M.P.P from the University of Maryland School of Public Policy, and a J.D. from the University of Maryland School of Law.
