Description: When lawyers discuss and advertise their prowess and successful representation of clients’ matters, they must be mindful of the ethical rules that surround such marketing activities, whatever the platform.
 
This CLE will examine the ethical perils that arise where imprecise comments about their own credentials and their clients’ matters appear in firm marketing material, such as the firm’s website or newsletters, or inadvertently end up in the press or on social media.
 
ABA Rules of Professional Conduct that will be covered during this CLE include Rules 1.6; 1.7; 3.6; 5.1; 5.3; 7.1; and 8.4(d).
 
Presenter Bios 
 
Aaron Lawson advises lawyers and law firms on professional responsibility, risk management, and professional liability issues. Aaron also assists law firms on matters concerning organization, management, policies, and structure. In addition, he represents insurers in arbitration and litigation matters across different industries.
 
Prior to joining the corporate legal industry, Aaron was an appellate court attorney at the New York Appellate Division, Third Department. His background in state government includes working for the Senate Finance Chair of the New York State Senate. During law school, Aaron was a legal intern in the Administrative Law Division of the Office of the Attorney General for the Commonwealth of Massachusetts.
 
Anthony Davis is a lawyer’s lawyer. He advises lawyers and law firms in the United States and internationally in the areas of professional responsibility, risk management and every aspect of the law governing lawyers. Anthony is the author of books, numerous scholarly articles, and the bi-monthly "Professional Responsibility" column in the New York Law Journal.
 
Anthony is a Lecturer-in-Law at Columbia University School of Law, teaching “Professional Responsibility Issues in Business Practice.” He is a past President of the Association of Professional Responsibility Lawyers (APRL), a Fellow of the College of Law Practice Management, and a Member of the American Law Institute (ALI).
