Description: Representing ERISA fiduciaries, plans and plan sponsors raises a variety of ethical issues that can be a trap for the unwary practitioner. These problems can arise from the fact that a potential client may assume, perhaps unwittingly, a variety of sometimes competing roles and, as a result, counsel may find him/herself ensnared in a potentially difficult situation. The peculiar duties owed to plan participants have given rise to case law that can result in disqualification orders and other problems for the attorney.
