At the onset and during the height of the COVID-19 pandemic, many commercial tenants that were unable to pay rent raised legal defenses (including arguments based on the doctrines of frustration of purpose and impossibility as well as the force majeure provisions in their leases) seeking to be excused from nonpayment and their other lease obligations. Nearly three years, New York courts have had ample opportunity to decide numerous cases between commercial landlords and tenants. 
 
This program will provide attorneys with an update regarding the viability of COVID-era defenses, as well as practical litigation tips for counsel.
 
Presenter Bios  
 
Massimo F. D’Angelo focuses his practice on real estate litigation and transactional work. Massimo represents condominium and cooperative boards on matters related to general corporate governance and he serves as lead trial counsel for boards and developers on construction defect cases. He regularly represents commercial and residential landlords in connection with complex real estate litigation matters, and advises clients in connection with real estate administrative and environmental proceedings. He has extensive experience in conducting trials and arguing appeals in both state and federal court.
 
He also has experience with litigation of sophisticated commercial lease issues and landlord-tenant matters, and has negotiated numerous high value settlements on behalf of his clients.
 
 
Gregory Wong focuses his practice on litigation involving real estate and commercial disputes. He regularly represents clients in complex cases in state and federal courts. He also advises real estate firms, property management companies, and financial institutions in connection with using and operating commercial real estate.
