Description: This course will review the federal, state and local laws and guidelines regarding COVID-19 that govern private workplaces in NYC. The presentation will address the NYC vaccine mandate and to whom it applies as well as how to respond to workers seeking exemptions from vaccine mandates. The course presenter’s will break down the New York State and New York city requirements for time off for workers, and their children, to receive COVID-19 vaccinations and boosters. The presenters will also explain the New York Hero Act requirements, including what actions business owners must take both when the prevention plans are activated and when they are not. The course will address current guidance around masking.
 
Finally, the presenters will discuss the policies that employers should consider implementing based on the current guidance pertaining to isolation and quarantine after exposure to COVID-19 or a confirmed case of COVID-19.
 
 
Presenter Bios
 
 
Randi B. May represents employers and executives in all aspects of the employment relationship. She focuses on counseling, advice, and litigation avoidance, but will litigate when appropriate and desired.
 
Randi’s counseling experience on behalf of a broad range of employers includes advice concerning sexual harassment, discrimination and retaliation, policies, practices and trainings, workplace investigations, hiring and separation, employee discipline, employee misconduct, restrictive covenants, compensation, wage and hour issues, leaves of absence, and all other federal and New York state laws governing employment. She regularly drafts, updates, and negotiates agreements and policies.  Her counseling experience on behalf of executives includes drafting, negotiating, and advising clients concerning executive employment agreements, deferred compensation and equity grants, separation agreements, shareholder agreements and other basic business arrangements, and all forms of restrictive covenants, including forming a competitive business or leaving to join a competitor.
 
Randi has litigated before federal and state courts, administrative agencies, and arbitration panels, including conducting trials and hearings. Her experience includes the defense and prosecution of discrimination, harassment and retaliation claims, overtime and wage-and-hour claims, breach of contract, compensation disputes, breach of fiduciary duty, unfair competition, restrictive covenant disputes, and other claims relating to the termination of employment.
 
Randi has also published articles on New York’s recent sexual harassment law, the Fair Labor Standards Act, and the use of BlackBerry mobile devices in the workplace, and has been quoted in the New York Law Journal and Portfolio Media. She recently presented a CLE on the FLSA and on New York’s sexual harassment laws.
 
Randi has been named an Employment Law "Trailblazer" by the National Law Journal, as well as a "Labor & Employment Star - Northeast" by Benchmark Litigation. She has also penned several publications for Law 360 and the New York Law Journal. Her latest article in the New York Law Journal covers employer considerations on reopening business in the time of COVID-19. 
 
 
Amory McAndrew is an employment lawyer and commercial litigator recently named a “Woman Worth Watching” for her professional and community achievements.
 
Amory counsels employers in best practices on employment law matters, including reviewing and drafting employee handbooks and policies, hiring and termination, compliance with wage and hour laws, assessing employee accommodation requests to ensure compliance with the Americans with Disabilities Act, and preventing discrimination, harassment and retaliation claims. She also investigates internal reports of discrimination and harassment.
 
In addition, Amory represents executives in negotiating employment and separation agreements.
Drawing on her experience as a private company director and businesswoman, Amory represents large, small and startup businesses. She is currently acting as the primary outside counsel for a technology consulting firm, and she often advises clients in the retail and fashion industries.
As a commercial litigator, Amory is trial counsel for a medical devices company in a proxy contest. She has handled securities and other business and employment cases.
 
Amory is spearheading the firm’s women’s initiative, developing strategies to further HNRK’s commitment to diversity and inclusion. She is also plays an active role in several community philanthropic organizations.  Before joining Hoguet Newman Regal & Kenney, Amory was an associate in the commercial litigation practice of Howrey LLP.
