This program will cover significant developments in biometric privacy laws and their impact on workplace class action litigation, focusing on lawsuits arising from the 2008 Biometric Information Privacy Act of Illinois (BIPA) as well as recent laws modeled on it by other states.
 
The speakers will discuss significant rulings, upcoming legislation, and what can be expected on these issues in 2022 and beyond.
 
 
Presenter Bios
 
 
Jerry Maatman Jr. has defended some of the most significant bet-the-company cases ever filed against corporate America. He has represented companies, executive teams, and boards across the country in class action litigation, ranging in size from hundreds to tens of thousands of claims by employees. As such, he has seen virtually every litigation challenge conceivable. He approaches each case by owning the problem and viewing it from the client's perspective. By understanding and prioritizing his clients' objectives and goals, Jerry is able to solve exceptionally complex legal issues in an efficient and capable manner. His are the hands clients want on the steering wheel of the defense of their significant litigation.
 
While he is known to be a fierce litigator, Jerry also helps his clients see ahead and prevent issues that could turn into litigation. For instance, he pioneered the process of conducting employment-practices audits to assist employers in structuring effective and practical personnel policies and protocols. These audits were designed to minimize the incidence of employment-related class action litigation and to maximize management discretion and workplace productivity. This concept was formed by keeping the clients' needs at the top of his priority list, allowing him to provide integral assistance to myriad businesses and corporate boardrooms throughout his career.
 
Communication is at the center of Jerry's client service philosophy, no matter how large or complex the case. Each month, Jerry prepares comprehensive reports for his clients that document that latest updates in all of their active cases. Jerry's reports are often accompanied by a preview of the upcoming challenges in a case, or a calendar noting important deadlines. This is a process that Jerry has conducted every month for nearly 20 years. Over this time, Jerry has learned that those reports allow clients to more easily understand the current status of their cases without any unnecessary effort on their end.
 
 
Jennifer Riley has defended companies faced with significant complex litigation matters. She regularly defends companies facing class actions, collective actions, pattern or practice lawsuits, and other types of representative proceedings, ranging in size from dozens to tens of thousands of claims. As such, Jennifer works on the forefront of the developing law in an ever changing arena. She regularly develops strategies for navigating some of the largest challenges faced by corporate America today and counsels employers confronted with a range of complex employment law theories that span from claims of discrimination or sexual harassment to myriad types of alleged wage & hour violations.
 
Jennifer is a regular speaker and presenter regarding developments in the law and challenges on the horizon. As such, she strives to stay abreast of trends and changes in the employment litigation space. She constantly looks ahead to predict new challenges and to develop new tools to prevent and to defend such claims. Jennifer knows how to develop and employ successful strategies to navigate and successfully defend complex actions at inception, as well as by fracturing large-scale actions and by structuring creative solutions.
 
Jennifer has extensive litigation experience. She has represented clients facing bet-the-company cases in a wide range of complex civil litigation matters in federal and state courts across the country. She has served as trial counsel in federal court bench trials, jury trials, and arbitration proceedings. Jennifer has successfully defended a multitude of actions by securing dismissal, defeating class or collective action certification, prevailing on summary judgment, and structuring and securing approval of complex and multiparty settlements and consent decrees. Jennifer also routinely counsels employers to navigate thorny employment issues, including through investigations and terminations.
 
Prior to joining Seyfarth, Jennifer worked as a commercial litigator at another Chicago Vault 50 firm. In addition to her experience in private practice, Jennifer also worked as in-house counsel for a Fortune 100 pharmaceutical and medical device company. As in-house counsel, Jennifer investigated, managed, and resolved a wide range of disputes in the commercial and employment areas, including single and multi-plaintiff discrimination, harassment, retaliation, and wage & hour cases.
