Description: The pandemic has engendered a real war for talent, as lawyers at all levels of seniority are looking for better opportunities and work environments. For many lawyers, retaining the flexibility to work from home when and as often as they would like is a paramount consideration. Research surveys have confirmed that this is particularly true for women and diverse lawyers, especially those with young children. In fact, many of them have voted with their feet by leaving employers who failed to offer sufficiently attractive hybrid work policies. At the same time, however, clients are demanding that law firms have a pipeline of mid-to-senior level women and diverse lawyers who can handle their matters, and therefore attrition poses a serious problem.
 
In this program, we will explore how legal employers can create workplace policies and cultures that will attract and retain lawyers and keep them engaged and connected, regardless of where they work. We will also discuss the need for employers to prevent the recurrence of the pre-pandemic gender divide among those who availed themselves of part-time or flex-time work policies, and steps that individual lawyers can take to help ensure that working remotely does not impede their advancement and success.
 
 
Presenter Bios 
 
Roberta (“Bobbi”) Liebenberg is a senior partner at Fine, Kapan and Black in Philadelphia and also a principal in The Red Bee Group, a women-owned consulting group that uses data-based strategies to attain DEI objectives. She focuses her practice on antitrust, class actions, and complex commercial litigation, and has been appointed by courts to represent classes in many class actions. She is now Lead Counsel for the End Payer Class in the Generic Pharmaceuticals Pricing Antitrust Litigation, which is the largest pending antitrust MDL in the country. She was also one of trial counsel for the class in the Urethanes Antitrust Litigation, where a $1.06 billion judgment was entered against Dow Chemical Company after a four-week jury trial. That was the largest price-fixing judgment ever. The judgment was affirmed by the Tenth Circuit and, during Dow’s appeal to the Supreme Court, it settled for $835 million, the most ever obtained from a single defendant in a price-fixing case. She has also defended Fortune 500 companies, including Southwest Airlines, and Temple University in class actions and other complex commercial litigation.  
 
She has written and spoken extensively about many issues of importance to women lawyers and has chaired numerous organizations devoted to gender equality in the profession, including the ABA Commission on Women in the Profession, the ABA Gender Equity Task Force, the ABA Presidential Initiative on Achieving Long Term Careers for Women in Law, DirectWomen (the only organization devoted to increasing the number of women attorneys on corporate boards), the Pennsylvania and Philadelphia Bar Associations’ respective committees on women in the profession, and the Pennsylvania Interbranch Commission for Gender, Racial and Ethnic Fairness. She has received many awards and honors, including induction into the American Antitrust Institute Private Enforcement Hall of Fame, the Margaret Brent Women Lawyers of Achievement Award from the ABA Commission on Women in the Profession, the Lynette Norton Award from the Pennsylvania Bar Association, the Sandra Day O'Connor Award from the Philadelphia Bar Association, and the Florence K. Murray Award from the National Association of Women Judges. She was named by former Pennsylvania Governor Edward Rendell as a "Distinguished Daughter of Pennsylvania,” and The National Law Journal named her as one of the “50 Most Influential Women Lawyers in America” and also one of the “Elite Women of the Plaintiffs’ Bar.” 
 
Stephanie Scharf is a leading authority for the advancement of women in the legal profession. She is well known as a thought leader in areas of organizational excellence, diversity, equality and inclusion, strategic growth, talent development, and enterprise management. Her consulting work is enhanced by over 30 years of practice in complex litigation representing national and global corporations, as a partner at Kirkland & Ellis, a partner at Jenner & Block and, most recently, founder of Scharf Banks Marmor LLC, a nationally prominent women-owned law firm.
 
Stephanie has a Ph.D. in Behavioral Sciences and a J.D. from the University of Chicago. She combines her skills in data analytics to create measurable strategies for organizational change and achievable goals. She has published innovative research on such topics as the success of law firms in retaining and advancing lawyers, attributes of effective leadership, and strategies for growth and talent development. Stephanie designed and co-authored the innovative ALM/ABA research, Walking Out the Door: the Fact, Figures and Future of Experienced Women Lawyers in Private Practice; designed and co-authored First Chairs at Trial: More Women Need Seats at the Table; founded and conducted the NAWL Annual Survey of Women in Law Firms from 2006-2014; and conducted other applied research on the strategies, career trajectories, and impact of interaction between law organizations and their employees.
 
Stephanie has held many leadership positions in national organizations. She is the 2017-2020 Chair of the American Bar Association Commission on Women in the Profession and also co-chairs the ABA Presidential Initiative on Achieving Long-Term Careers for Women in the Law. Stephanie also served as Special Advisor to the American Bar Association’s Presidential Commission on Diversity and Inclusion. She is a member of the Board of DirectWomen and a former President of the National Association of Women Lawyers, where she created the highly regarded NAWL General Counsel Institute as well as a series of NAWL national surveys.
