Description: New York State’s 2022 budget made significant amendments to the state’s Brownfield Cleanup Program (BCP), which has been a significant driver of environmental remediation and site redevelopment in New York State for the past 20 years. The amendments include a 10-year extension of the eligibility for sites to qualify for tax credits, extensions of deadlines for claiming those credits, and additional tax incentives for sites in disadvantaged communities and renewable energy sites.
 
In this program, BCP practitioners David J. Freeman, Lawrence P. Schnapf, and Matthew J. Sinkman will analyze the 2022 amendments and how they will affect site owners, developers, community groups and others interested cleaning up sites under BCP.
 
 
Presenter Bios
 
Mr. Freeman has over 35 years of experience representing buyers, sellers, and developers of contaminated properties, as well as both plaintiffs and defendants in Superfund and other litigation regarding the cleanup of hazardous waste sites. He is a frequent author and speaker on environmental law topics. He is the recipient of the 2021 Distinguished Service Award from the New York City Brownfield Partnership and a 2012 Burton Award as “an outstanding law firm author.” His extensive bar association and pro bono activities include service as President of the New York City Brownfield Partnership, Vice Chair of the New York State League of Conservation Voters Education Fund, Co-Chair of the New York State Bar Association Environmental Law Section Committee of Hazardous Waste/Site Cleanup, and Special Legal Counsel to the United Nations Environment Programme for North American Environmental Affairs.
 
Lawrence P. Schnapf is an environmental attorney based in New York City and New Jersey with over 35 years of national environmental transactional experience and is the principal of Schnapf LLC. With this background and his geology training, Larry is uniquely qualified to handle the legal and technical issues commonly encountered with environmental issues.
 
Larry primarily concentrates on environmental risks associated with corporate, real estate and brownfield transactions; commercial financing including asset-based lending, syndicated loans, mezzanine loans and distressed debt; bankruptcy, workouts and corporate restructuring. He has extensive experience with brownfield redevelopment and financing, including representing affordable housing developers and assisting local development corporations or not-for-profit organizations with their brownfield planning programs. Larry also counsels clients on environmental, represents clients in federal and state environmental litigation, enforcement actions, administrative proceedings and private cost recovery actions. He has also served as liaison counsel for PRP steering committees.
 
 
Mr. Sinkman represents plaintiffs and defendants in Superfund and other litigation matters regarding the cleanup of hazardous waste sites. He also represents buyers, sellers, and developers of contaminated properties.
 
Mr. Sinkman is a former Assistant Attorney General in the New York State Office of the Attorney General’s Environmental Protection Bureau. In that role, he represented New York State agencies and handled Superfund cost recovery and natural resource damages litigation; litigation against manufacturers of firefighting foam, suppliers of per- and poly-fluoroalkyl substances (PFAS), and the federal government, seeking in excess of $50 million for PFAS contamination at 69 sites in New York; leadership and coordination with other states on discovery and strategy regarding firefighting foam litigation; the creation of a multistate coalition regarding PFAS; litigation against an international organization seeking more than $40 million in flooding damages; and other environmental enforcement matters.
