Description: Over the course of the last year, the Federal Government has doubled-down on incentivizing cybersecurity compliance, especially for those that do business with Federal agencies. As perhaps their most significant innovation, the U.S. Department of Justice has prioritized using one of its most potent tools, the False Claims Act, to enforce compliance through severe treble-damages penalties that can be crippling for businesses and their executives, who face personal liability under the Act. Presenter Bios
 
Laura Schwalbe vigorously defends clients facing government investigations, coordinates internal and independent investigations, and represents clients in complex litigation. Clients trust her trial experience and her knowledge of government agencies to guide them through their legal challenges.
 
Laura helps clients respond to investigations, audits, and examinations by agencies including the U.S. Department of Justice, the Securities & Exchange Commission, the Financial Industry Regulatory Authority, and the Consumer Financial Protection Bureau, as well as by various state Attorneys General.
Her comprehensive experience includes fact gathering, overseeing and coordinating responses to government requests, preparing individuals for depositions and testimony, and negotiating with government agencies. She has defended clients through trial and appeal against the Securities and Exchange Commission.
 
Before joining Harter Secrest & Emery, Laura worked in the securities litigation and enforcement group in the Washington, D.C. office of Wilmer, Cutler, Pickering, Hale & Dorr LLP and in the litigation group in the New York City office of Cadwalader, Wickersham & Taft LLP.
 
Brian Feldman is a tenacious and respected trial and appellate lawyer who thrives in high stakes matters.
 
As chair of the firm’s Government and Internal Investigations practice group, Brian vigorously defends clients who face federal and state investigations and conducts nimble internal investigations to guide organizations through crises and other difficult situations.
 
Brian has broad experience on all sides of investigations, including in health care, higher education, and other regulated areas, and in litigation under the False Claims Act and similar fraud statutes.
 
Brian draws on investigative and litigation skills he first developed as Senior Litigation Counsel in the United States Attorney's Office for the Southern District of New York in Manhattan. His clients in private practice have ranged from individuals and not-for-profits to Fortune 500 companies.
