Description: A discussion of recent trends in consumer litigation about false advertising of food and beverage products, and trends in the federal agency regulations of food and beverage labeling. Included will be topics such as the evolving definition of the “reasonable consumer” standard and how this has shaped federal circuit court decisions pertaining to the food and beverage industry, particularly in granting motions to dismiss cases at early stages.
The presentation will also cover recently enacted and proposed rules by the FTC, FDA, and state agencies regarding the advertising and labeling of food and beverage products, and how the Biden administration has handled these areas during its first year.
Presenter Bios
Pooja Nair is a litigation partner at Ervin Cohen & Jessup LLP in Beverly Hills, California and heads the Firm’s food, beverage and hospitality practice. She works with entrepreneurs at all stages helping them find creative, long-term solutions to their business challenges. You can reach her at pnair@ecjlaw.com.
Pooja focuses on finding creative, long-term solutions to the business problems affecting companies of all sizes, from startups to publicly traded entities. She combines litigation experience with a strategic perspective, so that legal decisions make sense on a business level.
She has published extensively on business law and food and beverage legal issues for publications including Law 360, Daily Journal, Eater, California Lawyer and Bloomberg BNA. She writes a bi-monthly column for Modern Restaurant Management on legal developments affecting restaurants.
Catherine Veeneman is an Associate in the Litigation Department.
Cate’s practice focuses on general commercial litigation. She has represented a broad range of companies, including banks and other lending institutions, as well as national retail companies in class actions and other complex commercial disputes. She regularly works in both state and federal court.
During law school, Cate received an award for “Excellence in Preparation for Trial Practice” from the American Board of Trial Advocates.
