Description: This year, many businesses have been unable to obtain microchips they need for their products. Microchip manufacturers have been affected by fires, utility outages, and other damage to their factors. Fortunately, resulting financial losses may be covered by insurance. This presentation will discuss the availability of insurance coverage for these and other types of contingent business interruption losses. We also will discuss what steps affected businesses should be taking to maximize their recovery and avoid potential pitfalls.
 
Mike Levine has more than 25 years of experience litigating insurance disputes and advising clients on insurance coverage matters.
Mike Levine is a partner in the firm’s Washington, DC office and a member of the firm’s Insurance Recovery team. Mike’s policyholder representation focuses on:
 
  • Property damage and business interruption claims, including COVID-19 losses
  • Event cancellation insurance counseling
  • Representations and warranties coverage
  • Commercial, professional, corporate and employment liabilities under CGL, pollution, E&O, D&O and EPLI insurance policies
 
Mike has spent his entire career advising clients about insurance and handling insurance coverage disputes. As a young lawyer, Mike represented the insurance industry in some of the highest-stakes matters, including the property, liability and appraisal proceedings arising from the Sept. 11 terrorist attack on the World Trade Center. Mike has devoted the latter half of his career to helping policyholders obtain the insurance recoveries they deserve, where Mike leverages his substantial insurance industry experience to maximize his clients’ insurance recoveries.
 
In recent years, Mike has recovered hundreds of millions of dollars of insurance proceeds for clients under general liability, property, directors and officers, cyber, errors and omissions, employment, environmental, and representations and warranties insurance coverages.
 
Mike is a prolific writer and frequently serves as a faculty member and lecturer on issues concerning insurance recovery, insurer bad faith and unfair claims practices and assessing coverage for new and emerging risks, such as COVID-19, cyber and disruptive technologies. Mike also serves as an editor of the ABA’s insurance coverage journal, Coverage, as well as manager and editor of the firm’s Insurance Recovery Blog.
 
Joseph Niczky’s practice focuses on complex insurance disputes, bad faith litigation, and advising policyholders on coverage issues.
 
Joseph has extensive commercial litigation experience, including numerous insurance-related matters. Joseph represents commercial policyholders in matters stemming from all types of insurance policies, including commercial property, E&O, D&O, and reinsurance.
 
Joseph is also committed to pro bono work, and has successfully represented multiple clients in obtaining asylum.
 
Joseph is admitted to practice in New York, the US District Court for the Southern District of New York and the US District Court for the Eastern District of New York.
 
Relevant Experience
  • Represented cedent in eight-day jury trial involving facultative reinsurance and disputes over allocation, primary policy limits, and umbrella policy coverage for defense costs.
  • Advised policyholders, insurers, and reinsurers on coverage issues relating to the COVID-19 pandemic, in particular for commercial property insurance policies.
  • Successfully defended reinsurance broker and captive manager against allegations of negligence brought by an underlying insured in complex reinsurance dispute involving trade credit insurance policy and facultative reinsurance agreement.
