Description: Globalization is not a recent phenomenon, yet bankruptcy practitioners are often stumped when the bankrupt debtor has assets, liabilities or potential causes of action outside of the home country. In this podcast episode, three lawyers specializing in cross-border insolvency and litigation discuss recent developments in the United States, Great Britain and Brazil. A Brazilian lawyer will discuss Brazil’s recent implementation of the UNCITRAL Model Law on Cross-Border Insolvency. An English solicitor will look at remedies available in the English courts to support efforts to recover assets, in accordance with the principles in the Model Law and more generally through Mareva/freezing injunctions and Norwich Pharmacal Orders. A US lawyer will address the treatment of corporate groups in cross-border cases and recent decisions of interest arising under the Model Law.
Sarah Murray is head of the dispute resolution practice and deals with a wide range of commercial disputes both in the High Court and through arbitration.
Sarah trained at a City firm and joined Stevens & Bolton in 2003. She became a partner in 2013.
Her clients range from large corporates to owner-managed businesses and she provides strategic expertise and risk management advice. Her focus is on resolving disputes quickly, effectively and commercially. She regularly provides advice on contentious issues to a number of household name clients, particularly in the retail and manufacturing sector.
Sarah is further experienced in advising clients in relation to issues relating to or concerning fraud. She leads a cross-practice team advising clients affected by fraud and is experienced in obtaining interim injunctive relief in support of asset tracing and related litigation as well as dealing with some of the regulatory aspects of fraud work (for example advising in relation to FCA investigations).
Sarah has a wealth of experience in cross border litigation and arbitration and works regularly with lawyers and clients in other jurisdictions, either co-ordinating and leading teams of lawyers or providing support as part of a team. She has strong links with international firms in a number of jurisdictions as a result of her role on the firm’s International Practice Group (responsible for international business development and strategy) and leading the firm’s US Practice Group, managing relationships with law firms and other intermediaries across the USA.
Felipe Vieira has consolidated experience in international legal proceedings related to transnational insolvency and fraud, having actively participated in the development global strategies for the recovery of misappropriated and / or hidden assets through the most varied corporate structures.

Nyana Abreu Miller, an attorney at Sequor Law, focuses her practice on cross-border insolvency, marital asset recovery and financial fraud. Nyana has worked on cases brought under Chapter 15 of the U.S. Bankruptcy Code on behalf of foreign office holders of bankrupt Latin American companies and financial institutions where insiders concealed hundreds of millions of dollars’ worth of assets into or through the United States. She has represented individuals, corporations, receivers and trustees in applications for assistance in obtaining evidence under 28 U.S.C § 1782, in litigation and in judgment enforcement proceedings. Nyana has domesticated and enforced foreign judgments under Florida’s Uniform Out-of-country Foreign Money-Judgment Recognition Act.
Nyana currently serves as the Latin America Regional Director for the International Women’s Insolvency and Restructuring Confederation (IWIRC). She is a member of the International Section of the Florida Bar, the American Bankruptcy Institute and IWIRC. Nyana is regularly invited to present, in both English and Portuguese, on topics related to international asset recovery. She was honored by Super Lawyers Magazine as a 2020 Rising Star in Florida.
Prior to joining Sequor Law, Nyana worked on commercial, financial and real estate transactions at an international law firm. In that position, she represented bank syndicates in financial transactions for various purposes, including working capital, international trade and acquisitions.
