Description: It has become quite routine for attorneys to utilize protective orders or confidentiality orders in complex litigation matters. The reasons are multi-faceted, and can include something as simple as protection of one party (or both) parties’ confidential and proprietary information, and can range from expediting the flow of discovery material to facilitating the prompt and efficient resolution of disputes. However, certain decisions have warned against the overuse of protective orders. This program will provide a diverse discussion among plaintiff and defense counsel and a retired federal magistrate judge relating to protective orders generally, the protection of propriety information, and practice tips for attorneys involved in complex litigation who are facing similar issues.
The Honorable Joel Schneider, USMJ (Ret.d) is currently Of Counsel with the law firm of Montgomery McCracken Walker & Rhoads engaged in an ADR practice after he retired from the Bench in January, 2021. He was appointed to the position of United States Magistrate Judge in the District of New Jersey in October 2006 and sat in Camden, New Jersey. He was reappointed for a second eight (8) year term in October 2014. Judge Schneider settled, managed, decided and certified and approved settlements in thousands of cases, including hundreds of complex and multi-party individual and class and collective actions. Prior to his initial appointment, Judge Schneider was in private practice for 26 years where he specialized in complex civil litigation. Judge Schneider was recently appointed Special Master in the Johnson & Johnson/talc MDL. He is the co-author of the chapter on class actions published in the NJ Mass Tort and Class Action Treatise (NJICLE). While on the Bench Judge Schneider was the Compliance Judge for Arbitration in the District of New Jersey. He was also a member of the District’s Local Patent Rules, Information Technology and Pro Bono Committees. Judge Schneider was appointed by Chief Justice Roberts to be a member of the Federal-State Jurisdiction Committee of the Judicial Conference of the United States (2010-2016). Judge Schneider is on the Advisory Board of the Association of the Federal Bar of New Jersey, is an Advisor to the NJ District Court Historical Society, and is a member of the District of New Jersey’s Lawyer’s Advisory Committee. Judge Schneider was an Adjunct Professor at Rutgers Law School-Camden from Spring 2009 to Spring 2017 where he taught courses on civil litigation. He was an Adjunct Professor at Rowan University from Fall 2018 to Fall 2019 where he taught a course on civil aspects pertaining to law enforcement. Judge Schneider has authored hundreds of written opinions that are available in F. Supp. 2d and 3d, F.R.D., Westlaw and Lexis. He is a frequent lecturer on various topics involving civil litigation including settlement, management of complex litigation and electronic discovery.
Samantha Stillo is an associate on the Business and Commercial Litigation group at Wilentz, Goldman & Spitzer, P.A. Ms. Stillo focuses her practice in the area of complex business litigation, representing businesses in complex commercial disputes, such as breaches of contract, shareholder disputes, construction disputes, commercial real estate, and trade secret disputes.
Actively involved in the professional legal community of Monmouth County, she is a member of the Monmouth Bar Association and has been appointed to its Young Lawyers Committee and Chancery Practice Committee. Ms. Stillo is a member of the Monmouth University Alumni Association Board of Directors. She is also a member of the New York City, New York State and New Jersey Bar Associations. Since 2018, Ms. Stillo has been selected by New Jersey Super Lawyers as a Rising Star.
Prior to joining Wilentz, she practiced at a national law firm in New York City where she was part of a trial team that secured a favorable defense verdict for a client who was sued in a high-profile, multi-million dollar lawsuit. Ms. Stillo also worked on various construction litigation matters and general liability litigation matters.
Prior to working as a litigation attorney, she clerked for the Honorable Joseph W. Oxley, J.S.C in the New Jersey Superior Court, where she researched and drafted judicial opinions. Ms. Stillo has been certified as a Civil Mediator with the Special Civil Division-Small Claims Part.
Her previous legal experience also includes serving as a legal intern for: the Office of The New York State Attorney General; the New York City Department of Investigation; the Honorable Robert J. Gigante in Richmond County Surrogate’s Court where Ms. Stillo assisted in drafting an legal opinion on estate administration published in the New York Law Journal; and the Honorable Judith N. McMahon in the Richmond County Supreme Court.
While attending law school at Villanova University, Ms. Stillo was honored with the Dorothy Day Award for Pro Bono Service, which acknowledges students who have dedicated an exceptional amount of time to working with pro bono clients. She also received the Annual Villanova Law Institutional Scholarship. Ms. Stillo served as “student attorney” in the Civil Justice Clinical Program at Villanova, where she successfully represented clients in family law and healthcare administrative disputes.
Michael Zogby - Multinational clients turn to trial attorney Michael Zogby to litigate and manage risk related to aggregated proceedings and product liability and mass tort claims. Mike is an advocate for clients in the life sciences industry, and he also counsels clients in commercial and consumer disputes, class actions, intellectual property and antitrust challenges and trade secret violations. Mike serves as the deputy group leader in the firm’s nationally ranked product liability & mass torts practice, and is past chair of the firm-wide pharmaceutical and life sciences practice. Mike counsels clients in the United States, Asia and Europe on data privacy, governance and security, and crisis management, and he coordinates cross-border trial issues and discovery involving multidistrict proceedings and highly regulated industries. He is an elected member of the Products Liability Advisory Council and the International Association of Defense Counsel, a member of the Board of Directors for the Trial Attorneys of America, and a Trustee of the Trial Attorneys of New Jersey. He frequently contributes to journals and industry panel discussions on existing and emerging topics in life sciences, trial advocacy, cross-border litigation and product liability law. Mike serves on the faculty of the National Trial Advocacy College at the University of Virginia School of Law, and has lectured on trial ethics for practitioners at Fordham University School of Law.
Marlene Goldenberg joined GoldenbergLaw at the age of fourteen and has held nearly every position in the firm since that time. Today, Marlene’s practice is largely devoted to advocating for those who have been injured by defective medical devices and pharmaceutical drugs. Marlene also specializes in individual personal injury, product liability, and medical malpractice claims.
