Description:  
This CLE will address questions that just about every employer is asking right now. Can they, – and should they –require employees to get the vaccine, to protect themselves and others in their workplaces; what can they do if an employee refuses to return to work if his or her co-workers are not vaccinated; and conversely, what to do if an employee refuses to get vaccinated on religious or other grounds. Finally, this CLE will analyze the recent EEOC guidance on vaccines in the employment context and run through relevant hypotheticals.
 
Presenter Bios
 
Helene Hechtkopf is a litigation partner at Hoguet Newman Regal & Kenney, LLP.  She focuses on employment and commercial litigation, and her clients include entities large and small, including the Metropolitan Transportation Authority, and Metro-North Railroad.  She often defends her clients in employment cases alleging discrimination and retaliation under a variety of state and federal statutes, including race and gender discrimination, disability discrimination, and whistleblower laws.  Helene also defends her clients in class actions alleging civil rights violations and discrimination.
 
Helene works with her clients to avoid litigation where possible, and where that isn’t possible, to get to the best outcome – whether by settlement, winning on a motion, or winning at trial.
 
Helene has been recognized by New York Law Journal with the Rising Star award, which recognizes the region's most promising lawyers under age 40.  She has been named a New York “Super Lawyer” several times, and is a leader in the New York State Bar Association’s Commercial and Federal Litigation Section.
 
Amory McAndrew is an employment lawyer and commercial litigator recently named a “Woman Worth Watching” for her professional and community achievements.
 
Amory counsels employers in best practices on employment law matters, including reviewing and drafting employee handbooks and policies, hiring and termination, compliance with wage and hour laws, assessing employee accommodation requests to ensure compliance with the Americans with Disabilities Act, and preventing discrimination, harassment and retaliation claims. She also investigates internal reports of discrimination and harassment.  In addition, Amory represents executives in negotiating employment and separation agreements.
 
Drawing on her experience as a private company director and businesswoman, Amory represents large, small and startup businesses.  She is currently acting as the primary outside counsel for a technology consulting firm, and she often advises clients in the retail and fashion industries.
 
As a commercial litigator, Amory is trial counsel for a medical devices company in a proxy contest.  She has handled securities and other business and employment cases.
 
Amory is spearheading the firm’s women’s initiative, developing strategies to further HNRK’s commitment to diversity and inclusion.  She is also plays an active role in several community philanthropic organizations.
 
Before joining Hoguet Newman Regal & Kenney, Amory was an associate in the commercial litigation practice of Howrey LLP.
